It doesn't matter. This is a BBS. Can we not discuss it for fun?

That was not cool at all.

I dealt with other bbs brethren here before and I would never screw one over like that after I had agreed to buy something from them.

Own up to it Kof40 and let's move on...

What King of 40 acres did was unethical and wrong, but calling him out in public like that is even worse. Be a man, sack up, and take care of business in private, instead of whining to the board. The worst part is that it's only the day after. Gawd damn, at least give him a little time to explain what happened and possible rectify the situation. I can guarantee you that any possibility that there was of making this right is completely gone.

King of 40 acres - douche
airbullard - giant, festering, cottage cheese covered douche

I will take your word for it. Basically, the tickets were the consideration that bound Ko40A?

I'm another law student. This seems like pretty basic stuff. The consideration was the promise to pay and the promise to give up the tickets.

You're the douche in this situation. I don't think it's wrong for airbullard to come on here and let us know what Ko4A is doing to people. What if he tries to buy tickets from someone else on here for game 5/game 1?

So it was the promise? Thanks.

Note: don't make promises you can't keep :)

Yep, that's correct. In an overly-simplified way, you can think of a contract as "a promise for return consideration". Without consideration on both sides, it is merely a promise (which is a whole 'nother topic).

assuming there were no extraordinary circumstances that would prevent King of 40 acres from waiting a few more minutes and paying up like he promised, airbullard should be pissed and i don't see a problem with posting about it.

if things went down like he posted and all King of acres did was say, "I'm sorry," then King is the douche.

    I can agree to that
I probably would not have made it public
I might have alluded to it or been sarcastic about it

I am just going with the facts that are out there
    it was not right

Yeah, waiting to hear somebody else's side of the story and all the facts of the situation before lambasting them in public...what a concept!

I'm not pissed at airbullard's post as much as the timing of the whole situation. Damn, I'm suprised he didn't post from his blackberry during halftime...

So you guys are saying if you:

1.) were selling an item on eBay and the purchaser didn't buy it after winning your auction, you wouldn't leave negative feedback?

2.) if you'd entered into a contract to purchase a house from someone, then they found a better deal, you'd just say "oh well, golly gee, he was wrong, but I'm not going to let anyone know about it."

3.) you wouldn't be upset if you arranged to sell someone an item over this BBS, they backed out, causing you to lose over 100% of the agreed upon purchase price...and then someone comes along and says "oh yeah, they did that to me a couple of months ago, but I didn't want to call them out or anything."

not to mention this item had to be sold before a certain timeframe. its not like he could just wait another couple days to look for another buyer.

Isn't the point that all King's side story amounted to was "i'm sorry" and not much else? It's not like he couldn't have explained it in his reneg-ing phone call.

actually, i'm quite interested to hear King's side of the story. and frankly, if i were airbullard i'd be ballistic too. and it doesn't matter what the story is, King of 40 owes him the money for the tix for agreeing upon the purchase already.

I definitely overreated a little. airbullard, if you're reading this, I apologize for calling you a douche.

But gawddamn, this was posted an hour after the game ended!

Ebay is completely different than this site. Ebay has a formal process for handling complaints like this, since it happens all the time.

Also, whether this is a legally binding contract or anything is up for discussion, but last I heard, libel is just as illegal as breach of contract. There's a reason that jurors aren't allowed to discuss a court case until it ends.

wow the thread is longer than i thought. i want to read all the posts but i'm at work and for some reason people keep coming into my office..

anyways to keep it short, this matter has already ended happily for me because the rockets ended up winning last night. sweep coming.

i'm not gonna meet up this guy and tell him to give me money or anything.. the money isn't too much of a big deal. just wanted to vent some frustration.

the thing i hated was having to walk all the way around toyota center (also went inside B.U.S.) soliciting people and dealing with scalpers (which i hate). i hated wasting me and my friend aboinamedray's time when we went to the game early on purpose to enjoy the playoff festivities.

i do thank everyone for their professional and somewhat unprofessional legal advice :)

maybe vy will read this and send me season tickets for next season.
