    Actually, it's just a contract, period.

    This would be a case of estoppel if there was no consideration given by one of the parties. In this transaction, both parties offered forth their respective considerations for a promise to act on the behalf of the other party. Just a plain ol' contract.

    i'm not gonna argue on a technicality but it's no different when you take a bet with someone. a handshake isn't a "contract" but if someone lost a $50 bet to you, is it too much to expect that person to pay up?

    I'm a certified paralegal and I can tell you its a contract.

    Just because there isn't some beige parchment with a dotted line and an X on it doesn't mean its not a contract..

    I'm sure there is somebody with a JD on these forums, but I can tell you that I've been knee-deep in Contracts issues the past couple of weeks since my Contracts II exam is in a week and this is pretty basic contract formation stuff - something which was learned in the first couple of weeks in Contracts I class.

    Never said it has to be written. Just said there was no consideration to bound Ko40A. Does promising to act count? Legally speaking, not the right thing to do speaking.

    Me too. A lot of people are jumping to conclusions without hearing everything. Even if it is true, I think it is kind of a dick move to call someone out publically. I'd be pissed but I don't think I'd make a thread about it.

    That's my point.

    There has only been one side represented. Ko40A is getting stoned to death and he hasn't even voiced his version. If he did, then it might change peoples perception.

    This should have been handled between the 2 people, instead of in this forum, but that's just me. I'm reading it, because it's entertaining. I have a feeling it's going to get even more entertaining before it is eventually closed.

    Does the legality really matter, i don't think he's trying to take him to court, except for the court of public opinion. Right now, the majority seems to think it was a douchebag bush league thing to do and I agree.

    I would like to hear Kingof40's side, but if things played out like they've been described, I think anybody who sells things on here should not do business with him.
