Yates - Not Guilty by reason of Insanity

    But beating a dead horse does.

    I'm not saying at all that racism doesn't exist because it does but making every issue that pops up into the plight of the black man/woman is stupid. Have you ever thought that perhaps that kind of attitude could in some way perpetuate the racial tension in our country?

    I see that- the LSD example is stupid

    it is the under the law part I don't think is right- that should be changed because it twists what guilt really is-

    she killed them- that is wrong- at least from the children's point of view (if no one else) It has to do with right and wrong not mental capacity.

    If it were yours or mine we would both agree it was wrong.

    Now if she is insane and she could not help herself, fine.

    If justice is only valid based upon mental capacity then we need to have a God-like understanding of mental illness with regard to His own judgments. I don't think man has enough God understanding to do that.

    So, for me she was guilty and what ever they decide to do whether treatment or otherwise is fine with me. At least we understand that what she did was wrong -whether or not she knew that or had the ability to know should not affect the meaning of the term.

    I thank God He is a perfect judge, He will not do the wrong thing at all when it is her day, and I don't have a clue how He will see it. I trust His justice, grace, love and character.

    And I am also glad I wasn't on the jury.

    or they could have brought charges for some lesser offense, i suppose. on where here mens rea is less an issue. but i'm speculating there, because i've never been involved in a criminal case and i don't know if they could have brought manslaughter charges instead of murder charges.

    So for the record.... If she gets out of the hospital in, let's say, 15 years, and is back into society. She walks around in the streets and saw someone selling stuff that could be somewhat "Satanic" in her opinion. She takes out a gun and kills everyone in the store. Should she go back to the hospital?

    I think the people who thinks she should be locked up thinks this way because she's a threat to society if let go. I somewhat blame the father/husband too if she was treated for depression and possible insanity after the first kid to put her through 4 more.

    This has been my thought since the beginning, he has always struck me as a participant in this whole sad story. How did he not notice her psychosis?

    Let alone he hit on women during the first trial and remarried just two days before the retrial.

    Somethings wrong there.

    I was pissed at the dad because he had an "Oh well" attitude and said how he is going to stick by her side. There is something seriously wrong with that dude.

    my understanding is she'd be in the ward until such time as she's no longer deemed a threat to anyone, including herself.

    I doubt you'll find many people on here with thicker skin than me. But I have always had a problem with trite remarks, even though I use them on occasion, as well.

    They simply demean the argument/debate.

    thank you, I was waiting for you or rocket river to reply with that. and asking you guys to do almost after every post wasn't irritaing either.


    as far as her getting to live in a government hospital, have you guys ever seen "sling blade" i know its just a movie, but gov't mental hospitals aren't the most pleasant places. It's probably worse than a women's prison.

    For what, exactly? Should he have seen this? I don't know about you, but regardless of any wives behavior, I don't see how ANYONE could honestly predict she'd do what she did.

    She was mutilating herself and he didn't report it to her psychologist. That's something.

    Not nearly as irritating as having to read that if this was a minority or a male, they'd receive the death penalty.
