What did Jeff Gordon do in a past life to deserve this?

    So to play devil's advocate(not that I am disagreeing with you) what if she had been the one screwing around? Would that make a difference? What if they both did?Does that change the situation or is she still entitled to half?

    she's still entitled to half...that's community property law.. they were married, so what they earned during marriage is split equally.

    fault only comes into play when you're talking about spousal maintenance (alimony) and issues with children.

    I don't view marriage as about money. If the law states it is community property, it is community property.

    It makes no difference to me one way or the other.

    I'm not being hostile or anything, but I would sincerely like to know how a no fault divorce with joint custody of children=Every other weekend and a 2 hr dinner on Wednesday for Dads? I know that the court states the "best interest of the child", but why is it that mom's are the best interest by default?

    i'm with you on that argument. that concerns me, too. for too long it's been assumed that best interests means you live with mommy. i think some courts are getting better about this, though.

    believe me..i understand your concern..one of the guys i work with does family work, and we see that all the time.
