Tell him you'll gladly file suit in small claim's court. This isn't actually a bad route to go. They usually don't allow lawyers there, and if you have your case in order and can present it coherently in court, you've got a good shot to win. The question is what do you want. Repayment for the XBOX? The hard drive with game saves back? He, of course, could counter-sue for the Godfather picture back. He has a good case for replevin (I love that word). Are they worth more than the XBOX?
Just accept that you lost an Xbox. I'm sure you will get a chance to legally screw this guy over down the road so just forget the whole situation until that day comes.
I'm sorry, mate. Sounds like he's going to play hardball with you. You can threaten to take him to small claims court. Download the form and partially fill it in, and tell him you're willing to go through with it. Maybe he'll settle and just give you the cash. You could always ask for more money in court for the time spent filing the suit. You might also get to the point where it's just not worth fighting for a small amount of money. Do you really want to spend the time taking him to court?
It's going to be a hassle, so I am probably going to ask for more money...After he left last night when i told him that I wasn't going to give him the pictures back, he started texting me stuff that he couldn't say to my face, so I can't physically do anything to him because they already put this incident down on record, so I have to take him to court.
I think the more important question, one that no one has asked until now, is how in the HELL did you get 2 accounts and have both of them active?

If he texted you that he damaged your xbox, save those. That would solid evidence to present in court. That's a hard case to prove, because the witnesses would all be his friends.
