Vice President's role in outing of CIA agent under examination, sources close to prosecutor say Jason Leopold Cheney's role in CIA outing not known Special prosecutor Patrick Fitzgerald is trying to determine whether Vice President Dick Cheney had a role in the outing of covert CIA operative Valerie Plame-Wilson, individuals close to Fitzgerald say. Plame’s husband was a vocal critic of prewar intelligence used by President George W. Bush to build support for the Iraq war. The investigation into who leaked the officer's name to reporters has now turned toward a little known cabal of administration hawks known as the White House Iraq Group (WHIG), which came together in August 2002 to publicize the threat posed by Saddam Hussein. WHIG was founded by Bush chief of staff Andrew Card and operated out of the Vice President’s office. Fitzgerald’s examination centers on a group of players charged with not only selling the war, but according to sources familiar with the case, to discredit anyone who openly “disagreed with the official Iraq war” story. The group’s members included Deputy White House chief of staff Karl Rove, Bush advisor Karen Hughes, Senior Advisor to the Vice President Mary Matalin, Deputy Director of Communications James Wilkinson, Assistant to the President and Legislative Liaison Nicholas Calio, Secretary of State Condoleezza Rice, National Security Advisor Stephen Hadley and I. Lewis “Scooter” Libby - Chief of Staff to the Vice President and co-author of the Administration's pre-emptive strike policy. Rice was later appointed Secretary of State; her deputy Hadley was made National Security Advisor. Wilkinson departed to become a spokesman for the military's central command, and later for the Republican National Convention. Hughes was recently appointed Undersecretary of State. Several members of the group have testified before Fitzgerald’s grand jury. Cheney’s role under scrutiny Two officials close to Fitzgerald told RAW STORY they have seen documents obtained from the White House Iraq Group which state that Cheney was present at several of the group's meetings. They say Cheney personally discussed with individuals in attendance at least two interviews in May and June of 2003 Wilson gave to New York Times columnist Nicholas Kristof and Washington Post reporter Walter Pincus, in which he claimed the administration “twisted” prewar intelligence and what the response from the administration should be. Cheney was interviewed by the FBI surrounding the leak in 2004. According to the New York Times, Cheney was asked whether he knew of any concerted effort by White House aides to name Ms. Wilson. Sources close to the investigation have also confirmed that special prosecutor Patrick Fitzgerald is trying to determine Vice President Cheney's role in the outing of Mrs. Wilson, more specifically, if Cheney ordered the leak. Those close to Fitzgerald say they have yet to uncover any evidence that suggests Cheney ordered the leak or played a role in the outing of Mrs. Wilson. Still, the sources said they are investigating claims that Cheney may have been involved based on his attendance at meetings of the Iraq group. Previous reports indicate Cheney was intimately involved with the framing of the Iraq war. On Wednesday, The Wall Street Journal confirmed that the Iraq group was under scrutiny. “Formed in August 2002, the group, which included Messrs. [Karl] Rove and [Lewis] Libby, worked on setting strategy for selling the war in Iraq to the public in the months leading up to the March 2003 invasion,” the Journal reported. “The group likely would have played a significant role in responding to [former Ambassador Joseph] Wilson's claims” that the Bush administration twisted intelligence when it said Iraq tried to acquire yellow-cake uranium from Africa. Rove's "strategic communications" task force operating inside the group was instrumental in writing and coordinating speeches by senior Bush administration officials, highlighting in September 2002 that Iraq was a nuclear threat. Background The White House Iraq Group operated virtually unknown until January 2004, when Fitzgerald subpoenaed for notes, email and attendance records. Bush Chief of Staff Andrew H. Card Jr. created the group in August of 2002. “A senior official who participated in its work called it "an internal working group, like many formed for priority issues, to make sure each part of the White House was fulfilling its responsibilities," according to an Aug. 10, 2003, Washington Post investigative report on the group’s inner workings. Senior Bush adviser Karl Rove chaired meetings of the group. The group relied heavily on New York Times reporter Judith Miller, who, after meeting with several of the organization’s members in August 2002, wrote an explosive story that many critics of the war believe laid the groundwork for military action against Iraq. On Sunday, Sept. 8, 2002, Miller wrote a story for the Times quoting anonymous officials who said aluminum tubes found in Iraq were to be used as centrifuges. Her report said the "diameter, thickness and other technical specifications" of the tubes -- precisely the grounds for skepticism among nuclear enrichment experts -- showed that they were "intended as components of centrifuges." She closed her piece by quoting then-National Security Adviser Condoleezza Rice who said the United States would not sit by and wait to find a smoking gun to prove its case, possibly in the form of a “a mushroom cloud." After Miller’s piece was published, administration officials pursued their case on Sunday talk shows using Miller’s piece as evidence that Iraq was pursuing a nuclear bomb, even though those officials were the ones who supplied Miller with the story and were quoted anonymously. Rice's comments on CNN’s “Late Edition” reaffirmed Miller’s story. Rice said that Saddam Hussein was "actively pursuing a nuclear weapon" and that the tubes -- described repeatedly in U.S. intelligence reports as "dual-use" items -- were "only really suited for nuclear weapons programs, centrifuge programs." Cheney, on NBC's "Meet the Press," also mentioned the aluminum tubes story in the Times and said "increasingly, we believe the United States will become the target" of an Iraqi atomic bomb. Defense Secretary Donald H. Rumsfeld, on CBS's "Face the Nation," asked viewers to "imagine a September 11th with weapons of mass destruction.” President Bush reiterated the image of Rice’s mushroom cloud comment in his Oct. 7, 2002 speech. The International Atomic Energy Agency later revealed that Iraq’s aluminum tubes were never designed to enrich uranium. In February of 2003, WHIG allegedly scripted the speech Powell made to the United Nations presenting the United States’ case for war. Powell’s speech to the UN, United Press International reported, “was handled by the White House Iraq Group, which… provided Powell with a script for his speech, using information developed by Feith's group. Much of it was unsourced material fed to newspapers by the OSP. Realizing this, Powell's team turned to the now-discredited National Intelligence Estimate on Iraq. But some of Feith's handiwork ended up in Powell's mouth anyway.” Miller appears in Jury room again Miller’s second appearance before the grand jury investigating the CIA leak seems to be tied to her meeting and discussions in June of 2003 with I. Lewis “Scooter” Libby, Vice President Cheney’s chief of staff, sources close to the investigation said. The meeting came one year before the New York Times printed a lengthy mea culpa discrediting a half-dozen of Miller’s prewar stories on the Iraqi threat. Fitzgerald’s investigation resulted when allegations surfaced that Bush Administration officials had called reporters to circulate the name of the CIA officer, Valerie Plame-Wilson, in an attempt to discredit her husband, former Ambassador Joseph Wilson, a critic of the administration's Iraq policy. Wilson went to Niger in 2002 at the request of the CIA to investigate reports that Iraq was trying to buy uranium "yellow cake" to develop nuclear weapons. He found that the reports were not credible. Until now, Fitzgerald’s two-year investigation has focused on conversations Karl Rove and Lewis “Scooter” Libby have had with individual journalists, including Time magazine reporter Matthew Cooper and New York Times reporter Judith Miller. That has now changed. Fitzgerald has retraced his steps to an earlier period when he first began to examine the White House Iraq Group. During its very first meetings, Card's Iraq group ordered a series of white papers showing Iraq’s arms violations. The first paper, "A Grave and Gathering Danger: Saddam Hussein's Quest for Nuclear Weapons," was never published. However, the paper was drafted with the assistance of experts from the National Security Council and Cheney's office. “In its later stages, the draft white paper coincided with production of a National Intelligence Estimate and its unclassified summary. “But the WHIG, according to three officials who followed the white paper's progress, wanted gripping images and stories not available in the hedged and austere language of intelligence,” according to the Post. Eight months later, Joseph Wilson began to question the veracity of the Bush administration’s prewar intelligence in private conversations with reporters. His talk threatened to undercut the administration’s successful marketing campaign: that Iraq was an imminent threat to the United States and its neighbors in the Middle East. Wilson’s allegations threatened to chip away at the credibility of individuals such as Cheney, who, in dozens of speeches just a few months prior had said that Iraq was dangerously close to acquiring a nuclear weapon. It also threatened to ruin Miller’s credibility. It was then that Administration officials started to discredit Wilson. Now Fitzgerald is trying to find out whether Cheney was involved. In addition, at least six current and former Cheney staffers - most members of the White House Iraq Group - have testified before the grand jury, including the vice president's top honcho, Lewis (Scooter) Libby, and two top Cheney national security lieutenants. Cheney's name has come up amid indications Fitzgerald may be edging closer to a blockbuster conspiracy charge - with help from a secret snitch. "They have got a senior cooperating witness - someone who is giving them all of that," a source who has been questioned in the leak probe told the Daily News yesterday. Cheney was questioned last year byprosecutors and has hired a private attorney, former colleague Terrence O'Donnell, who declined to comment when contacted by The News. Cheney spokeswoman Lea Anne McBride only offered the standard canned response that her boss is cooperating. GEOPOLITICAL INTELLIGENCE REPORT10.17.2005 The Importance of the Plame Affair By George Friedman There are three rules concerning political scandal in the United States. First, every administration has scandals. Second, the party in opposition will always claim that there has never been an administration as corrupt as the one currently occupying the White House. Three, two is almost never true. It is going to be tough for any government to live up to the Grant or Harding administrations for financial corruption, or the Nixon and Lincoln administrations for political corruption -- for instance, was Lincoln's secretary of war really preparing a coup d'etat before the president's assassination? And sex scandals -- Clinton is not the gold standard. Harding was having sex with his mistress in the Oval Office -- and no discussion was possible over whether it was actually sex. Andrew Jackson's wife was unfairly accused of being a prostitute. Grover Cleveland had an illegitimate child. Let's not start on John F. Kennedy. Political scandal is the national sport -- the only unchanging spectator activity where a fine time is had by all, save the turkey who got caught this time. That is the fourth rule: Americans love a good scandal, and politicians usually manage to give them one. Thus, the Tom DeLay story is the epitome of national delight. Whether DeLay broke the law or the Texas prosecutor who claims he did is a Democratic hack out to make a name for himself matters little. A good time will be had by all, and in a few years no one will remember it. Does anyone remember Bert Lance or Richard Secord? As we discussed in previous weeks, scandals become geopolitically significant when they affect the ability of the president to conduct foreign policy. That has not yet happened to George W. Bush, but it might happen. There is, however, one maturing scandal that interests us in its own right: the Valerie Plame affair, in which Karl Rove, the most important adviser to the president, and I. Lewis Libby, the chief of staff to the vice president, apparently identified Plame as a CIA agent -- or at least did not vigorously deny that she was one when they were contacted by reporters. Given that this happened during a time of war, in which U.S. intelligence services are at the center of the war -- and are not as effective as the United States might wish -- the Plame affair needs to be examined and understood in its own right. Moreover, as an intelligence company, we have a particular interest in how intelligence matters are handled. The CIA is divided between the Directorate of Intelligence, which houses the analysts, and the Directorate of Operations, which houses the spies and the paramilitary forces. The spies are, in general, divided into two groups. There are those with official cover and those with non-official cover. Official cover means that the agent is working at the U.S. embassy in some country, acting as a cultural, agricultural or some other type of attaché, and is protected by diplomatic immunity. They carry out a variety of espionage functions, limited by the fact that most foreign intelligence services know who the CIA agents at the embassy are and, frankly, assume that everyone at the embassy is an agent. They are therefore followed, their home phones are tapped, and their maids deliver scraps of paper to the host government. This obviously limits the utility of these agents. Being seen with one of them automatically blows the cover of any potential recruits. Then there are those with non-official cover, the NOCs. These agents are the backbone of the American espionage system. A NOC does not have diplomatic cover. If captured, he has no protection. Indeed, as the saying goes, if something goes wrong, the CIA will deny it has ever heard of him. A NOC is under constant pressure when he is needed by the government and is on his own when things go wrong. That is understood going in by all NOCs. NOCs come into the program in different ways. Typically, they are recruited at an early age and shaped for the role they are going to play. Some may be tracked to follow China, and trained to be bankers based in Hong Kong. Others might work for an American engineering firm doing work in the Andes. Sometimes companies work with the CIA, knowingly permitting an agent to become an employee. In other circumstances, agents apply for and get jobs in foreign companies and work their way up the ladder, switching jobs as they go, moving closer and closer to a position of knowing the people who know what there is to know. Sometimes they receive financing to open a business in some foreign country, where over the course of their lives, they come to know and be trusted by more and more people. Ideally, the connection of these people to the U.S. intelligence apparatus is invisible. Or, if they can't be invisible due to something in their past and they still have to be used as NOCs, they develop an explanation for what they are doing that is so plausible that the idea that they are working for the CIA is dismissed or regarded as completely unlikely because it is so obvious. The complexity of the game is endless. These are the true covert operatives of the intelligence world. Embassy personnel might recruit a foreign agent through bribes or blackmail. But at some point, they must sit across from the recruit and show their cards: "I'm from the CIA and...." At that point, they are in the hands of the recruit. A NOC may never once need to do this. He may take decades building up trusting relationships with intelligence sources in which the source never once suspects that he is speaking to the CIA, and the NOC never once gives a hint as to who he actually is. It is an extraordinary life. On the one hand, NOCs may live well. The Number Two at a Latin American bank cannot be effective living on a U.S. government salary. NOCs get to live the role and frequently, as they climb higher in the target society, they live the good life. On the other hand, their real lives are a mystery to everyone. Frequently, their parents don't know what they really do, nor do their own children -- for their safety and the safety of the mission. The NOC may marry someone who cannot know who they really are. Sometimes they themselves forget who they are: It is an occupational disease and a form of madness. Being the best friend of a man whom you despise, and doing it for 20 years, is not easy. Some NOCs are recruited in mid-life and in mid-career. They spend less time in the madness, but they are less prepared for it as well. NOCs enter and leave the program in different ways -- sometimes under their real names, sometimes under completely fabricated ones. They share one thing: They live a lie on behalf of their country. The NOCs are the backbone of American intelligence and the ones who operate the best sources -- sources who don't know they are sources. When the CIA says that it needs five to 10 years to rebuild its network, what it is really saying is that it needs five to 10 years to recruit, deploy and begin to exploit its NOCs. The problem is not recruiting them -- the life sounds cool for many recent college graduates. The crisis of the NOC occurs when he approaches the most valuable years of service, in his late 30s or so. What sounded neat at 22 rapidly becomes a mind-shattering nightmare when their two lives collide at 40. There is an explicit and implicit contract between the United States and its NOCs. It has many parts, but there is one fundamental part: A NOC will never reveal that he is or was a NOC without special permission. When he does reveal it, he never gives specifics. The government also makes a guarantee -- it will never reveal the identity of a NOC under any circumstances and, in fact, will do everything to protect it. If you have lied to your closest friends for 30 years about who you are and why you talk to them, no government bureaucrat has the right to reveal your identity for you. Imagine if you had never told your children -- and never planned to tell your children -- that you worked for the CIA, and they suddenly read in the New York Times that you were someone other than they thought you were. There is more to this. When it is revealed that you were a NOC, foreign intelligence services begin combing back over your life, examining every relationship you had. Anyone you came into contact with becomes suspect. Sometimes, in some countries, becoming suspect can cost you your life. Revealing the identity of a NOC can be a matter of life and death -- frequently, of people no one has ever heard of or will ever hear of again. In short, a NOC owes things to his country, and his country owes things to the NOC. We have no idea what Valerie Plame told her family or friends about her work. It may be that she herself broke the rules, revealing that she once worked as a NOC. We can't know that, because we don't know whether she received authorization from the CIA to say things after her own identity was blown by others. She might have been irresponsible, or she might have engaged in damage control. We just don't know. What we do know is this. In the course of events, reporters contacted two senior officials in the White House -- Rove and Libby. Under the least-damaging scenario we have heard, the reporters already knew that Plame had worked as a NOC. Rove and Libby, at this point, were obligated to say, at the very least, that they could neither confirm nor deny the report. In fact, their duty would have been quite a bit more: Their job was to lie like crazy to mislead the reporters. Rove and Libby had top security clearances and were senior White House officials. It was their sworn duty, undertaken when they accepted their security clearance, to build a "bodyguard of lies" -- in Churchill's phrase -- around the truth concerning U.S. intelligence capabilities. Some would argue that if the reporters already knew her identity, the cat was out of the bag and Rove and Libby did nothing wrong. Others would argue that if Plame or her husband had publicly stated that she was a NOC, Rove and Libby were freed from their obligation. But the fact is that legally and ethically, nothing relieves them of the obligation to say nothing and attempt to deflect the inquiry. This is not about Valerie Plame, her husband or Time Magazine. The obligation exists for the uncounted number of NOCs still out in the field. Americans stay safe because of NOCs. They are the first line of defense. If the system works, they will be friends with Saudi citizens who are financing al Qaeda. The NOC system was said to have been badly handled under the Clinton administration -- this is the lack of humint that has been discussed since the 9-11 attacks. The United States paid for that. And that is what makes the Rove-Libby leak so stunning. The obligation they had was not only to Plame, but to every other NOC leading a double life who is in potentially grave danger. Imagine, if you will, working in Damascus as a NOC and reading that the president's chief adviser had confirmed the identity of a NOC. As you push into middle age, wondering what happened to your life, the sudden realization that your own government threatens your safety might convince you to resign and go home. That would cost the United States an agent it had spent decades developing. You don't just pop a new agent in his place. That NOC's resignation could leave the United States blind at a critical moment in a key place. Should it turn out that Rove and Libby not only failed to protect Plame's identity but deliberately leaked it, it would be a blow to the heart of U.S. intelligence. If just one critical NOC pulled out and the United States went blind in one location, the damage could be substantial. At the very least, it is a risk the United States should not have to incur. The New York Times and Time Magazine have defended not only the decision to publish Plame's name, but also have defended hiding the identity of those who told them her name. Their justification is the First Amendment. We will grant that they had the right to publish statements concerning Plame's role in U.S. intelligence; we cannot grant that they had an obligation to publish it. There is a huge gap between the right to publish and a requirement to publish. The concept of the public's right to know is a shield that can be used by the press to hide irresponsibility. An article on the NOC program conceivably might have been in the public interest, but it is hard to imagine how identifying a particular person as part of that program can be deemed as essential to an informed public. But even if we regard the press as unethical by our standards, their actions were not illegal. On the other hand, if Rove and Libby even mentioned the name of Valerie Plame in the context of being a CIA employee -- NOC or not -- on an unsecured line to a person without a security clearance or need to know, while the nation was waging war, that is the end of the story. It really doesn't matter why or whether there was a plan or anything. The minimal story -- that they talked about Plame with a reporter -- is the end of the matter. We can think of only one possible justification for this action: That it was done on the order of the president. The president has the authority to suspend or change security regulations if required by the national interest. The Plame affair would be cleared up if it turns out Rove and Libby were ordered to act as they did by the president. Perhaps the president is prevented by circumstances from coming forward and lifting the burden from Rove and Libby. If that is the case, it could cost him his right-hand man. But absent that explanation, it is difficult to justify the actions that were taken. Ultimately, the Plame affair points to a fundamental problem in intelligence. As those who have been in the field have told us, the biggest fear is that someone back in the home office will bring the operation down. Sometimes it will be a matter of state: sacrificing a knight for advantage on the chessboard. Sometimes it is a parochial political battle back home. Sometimes it is carelessness, stupidity or cruelty. This is when people die and lives are destroyed. But the real damage, if it happens often enough or no one seems to care, will be to the intelligence system. If the agent determines that his well-being is not a centerpiece of government policy, he won't remain an agent long. On a personal note, let me say this: one of the criticisms conservatives have of liberals is that they do not understand that we live in a dangerous world and, therefore, that they underestimate the effort needed to ensure national security. Liberals have questioned the utility and morality of espionage. Conservatives have been champions of national security and of the United States' overt and covert capabilities. Conservatives have condemned the atrophy of American intelligence capabilities. Whether the special prosecutor indicts or exonerates Rove and Libby legally doesn't matter. Valerie Plame was a soldier in service to the United States, unprotected by uniform or diplomatic immunity. I have no idea whether she served well or poorly, or violated regulations later. But she did serve. And thus, she and all the other NOCs were owed far more -- especially by a conservative administration -- than they got. Cheney aide cooperating with CIA outing probe, sources say A senior aide to Vice President Dick Cheney is cooperating with special prosecutor Patrick Fitzgerald in the outing of CIA agent Valerie Plame Wilson, sources close to the investigation say. Individuals familiar with Fitzgerald’s case tell RAW STORY that John Hannah, a senior national security aide on loan to Vice President Dick Cheney from the offices of then-Under Secretary of State for Arms Control and International Security Affairs, John Bolton, was named as a target of Fitzgerald’s probe. They say he was told in recent weeks that he could face imminent indictment for his role in leaking Plame-Wilson’s name to reporters unless he cooperated with the investigation. Others close to the probe say that if Hannah is cooperating with the special prosecutor then he was likely going to be charged as a co-conspirator and may have cut a deal. Hannah did not return two calls and several emails to his White House address seeking comment. Fitzgerald’s probe is investigating whether officials in the Bush Administration illegally outed a CIA agent to get back at her husband, former Ambassador Joseph Wilson, who was a critic of the Administration’s faulty intelligence and lead-up to war. In a July 2003 editorial, Wilson wrote that the Bush administration “twisted” pre-Iraq war intelligence in order to win public support for the Iraq conflict. Specifically, Wilson called into question the veracity of President Bush’s claim in his January 2003 State of the Union address that Iraq tried to purchase yellow-cake uranium from Africa. Wilson had been sent on a fact-finding mission to Niger a year before and reported that those allegations were unfounded. Bush administration officials said Wilson’s trip was a boondoggle, and was set up by his wife who worked at the CIA on weapons of mass destruction. Those close to the investigation said in June 2003, Hannah was given orders by higher-ups in Cheney’s office to leak Plame’s covert status and identity in an attempt to muzzle Wilson, who had been a thorn in the side of the administration since May 2003, when he started questioning the administration’s claims that Iraq was an imminent threat to the U.S. and its neighbors in the Middle East. The specifics of who issued those orders and what directives were given were not provided. Hannah had been fingered by Wilson To many following the case, Hannah’s involvement will not come as a surprise. Wilson pointed to Hannah as a possible leaker in his book, The Politics of Truth. “In fact, senior advisers close to the president may well have been clever enough to have used others to do the actual leaking, in order to keep their fingerprints off the crime,” Wilson writes. “John Hannah and David Wurmser, mid-level political appointees in the vice-president’s office, have both been suggested as sources of the leak …Mid-level officials, however, do not leak information without the authority from a higher level,” Wilson notes. The revelation that Hannah has become a prosecution witness strongly suggests that Fitzgerald is now looking into the motive for outing Plame and how Wilson’s complaints threatened to destroy public support for the war, which the Bush administration worked diligently to win. Fitzgerald may be looking at a broader conspiracy case of pre-war machinations by the White House Iraq Group (WHIG) and by the Pentagon’s ultra-secret Office of Net Assessment, the former operating out of Dick Cheney’s office and tasked with “selling” the war in Iraq, and the latter operating out of Defense Under Secretary for Policy, Douglas Feith’s office and tasked with creating a war to “sell,” as some describe. To spread its message that Saddam Hussein was a nuclear threat, the White House Iraq Group relied heavily on New York Times reporter Judith Miller, who, after meeting with several of the organization’s members in August 2002, wrote an explosive story that many critics of the war believe laid the groundwork for military action against Iraq. On Sunday, Sept. 8, 2002, for example, Miller wrote a story for the Times quoting anonymous officials who said aluminum tubes found in Iraq were to be used as centrifuges. Her report turned out to be wrong. Hannah under investigation for role with Chalabi group Hannah is currently under investigation by U.S. authorities for his alleged activities in an intelligence program run by the controversial Iraqi National Congress (INC) and its leader, Ahmed Chalabi. According to a Newsweek article, a memo written for the Iraq National Congress (INC) raised questions regarding Cheney’s role in the build up to the war in Iraq. During the lead up to the war, Newsweek asserts, the INC was providing intelligence on the now discredited Iraqi WMD program through Hannah and I. Lewis “Scooter” Libby, Cheney’s chief of staff. “A June 2002 memo written by INC lobbyist Entifadh Qunbar to a U.S. Senate committee lists John Hannah, a senior national-security aide on Cheney’s staff, as one of two ‘U.S. governmental recipients’ for reports generated by an intelligence program being run by the INC and which was then being funded by the State Department. Under the program, ‘defectors, reports and raw intelligence are cultivated and analyzed’; the info was then reported to, among others, ‘appropriate governmental, non-governmental and international agencies.’ The memo not only describes Cheney aide Hannah as a “principal point of contact” for the program, it even provides his direct White House telephone number.” “…Hannah and Cheney's chief of staff, Lewis ‘Scooter’ Libby, were the two Cheney employees,’ We believe that Hannah was the major player in this,’ one federal law-enforcement officer told the magazine. According to the Washington Post, Libby discussed Wilson's wife with at least two reporters before her identity became public.
Cheney resignation rumors fly By Paul Bedard Sparked by today's Washington Post story that suggests Vice President Cheney's office is involved in the Plame-CIA spy link investigation, government officials and advisers passed around rumors that the vice president might step aside and that President Bush would elevate Secretary of State Condoleezza Rice. "It's certainly an interesting but I still think highly doubtful scenario," said a Bush insider. "And if that should happen," added the official, "there will undoubtedly be those who believe the whole thing was orchestrated – another brilliant Machiavellian move by the VP." Said another Bush associate of the rumor, "Yes. This is not good." The rumor spread so fast that some Republicans by late morning were already drawing up reasons why Rice couldn't get the job or run for president in 2008. "Isn't she pro-choice?" asked a key Senate Republican aide. Many White House insiders, however, said the Post story and reports that the investigation was coming to a close had officials instead more focused on who would be dragged into the affair and if top aides would be indicted and forced to resign. "Folks on the inside and near inside are holding their breath and wondering what's next," said a Bush adviser. But, he added, they aren't focused on the future of the vice president. "Not that, at least not seriously," he said.
An in-depth investigation of the White House Iraq Group would be wonderful. In fact, if the special prosecutor does not go ahead with pressing charges on anybody, then Wilson and his wife will be that much more likely to go ahead with their civil suit. And as we already know from the Clinton years, those are more transparent, and easier to tangent into other areas. And when the Repubs cry partisanship, we only need look at the very recent example of president Clinton for why such an investigation is good and necessary.

I can go with this thinking to a certain extent, provided you agree that the Clinton suit was wrong. Allowing civil suits to harass a President is not a good thing. Of course, the Clinton civil suit by Paula Jones ?? was not even marginally related to his presidential duties, (who you screw or even sexually harass) while Bush and or/ Cheney's outting of an arms control under cover agent for political reasons does impact negatively on the president's duty to defend the United States.
Congrats on hitting the distinction set by the Supreme Court in Clinton v Jones as opposed to Nixon v. Fitzgerald. However, do you really think that Cheney outing a CIA agent would fall under the umbrella of official duties? IIRC that is the precedent as set in the Nixon case, Absolute Immunity from civil damages liability for acts done in "official capacity". I think that the USSC would say that illegal acts bar immunity.
