Criminal case, are you kidding me? I heard in California, at least in the past, you go to the traffic court only once for disputing a fine. Well judges in Midwest apparently have more free time on their hands.
quick question, can you get defensive driving and then defferred for another ticket at the same time? or would it be best to hire a lawyer and try to get one ticket dismissed?
It should be against the law. My issue with it is that the penalties have gotten way out of whack. Whole 'nother topic there.
Just got back from the court room. To all the well-wishers (including Falcons Talon), I say "Thank you". The case was dismissed.
I know this one works like a charm: 1. Plead not-guilty 2. Change the court date 3. Change the court date again 4. Change the court date again 5. By that time, not even the court is sure when your court date is. You can forget about the cop.
The cop said I was. I didn't believe I was. What else you want to know? BTW if you are curious, I did not heed the advice from of Independent Associate of PrePaid Legal Services, Inc.
I just want to know if you were speeding or not. Simple question. 42 over is not something that you don't know you were doing. Were you speeding or not. Even if it was 20 over...were you speeding? And thanks for the plug. I'm not a lawyer and I have never claimed to be. I sell a service to have access to lawyers.
Did I call you out? No! You jumped into my thread first to offer your moral advice, which I didn't need but took anyway. And today I thank those who supported my case. Your last post yesterday appeared to me sincere, so I specifically mentioned your name in my gratitude to dispel any animosity which might have incurred. My final answer to your repeated inquiry: I didn't believe I was driving 43 as the cop cited and that was the main reason I took it to court.
If I mistook your post as being a little sarcastic, I apologize. Posts can get taken out of context when all you can see is the typed word. I want to get this straight though. I thought the charge was 43 over the posted speed limit of 25. That would put you at 68. The charge was 43 in a 25? OK...now...so you are contesting the specific speed that was being charged. right?
Does it ****ing matter? He said that he doesnt think he was speeding. What else do you want him to say? Why are you making such a big deal about this? Congrats on getting your cased dismissed wnes.
43 over 25 is the language typically used by cops, not my invention, and I don't like that myself. Yes the charge was 43 in a 25 zone, the actual spot was 400 yards from my house in a subdivision.
If thats the case I apologize. Just seemed like you were constantly breaking his balls on this. Like said earlier, its hard to gauge how things are being said over a BBS sometimes.
So you know, "68 in a 25" and "43 in a 25" are two very different speeds. It was very disturbing to me to think of anyone traveling down my subdivision at that speed. While around 40 in a 25 is still a little high, it's not terribly off of 30-35, which is ideal. How'd you manage to get off?
