But factor in that Kobe went to Colorado for some sort of Arthroscopic knee surgery procedure at that time I believe. That probably menas that one of his legs was more that likely immoblized at the time, thus hindering his movements a little. I say "immoblized" because one would want to restrict movement to there knee after any operation to allow it to heal properly and take away as much pain as possible.

In light of this, I am guessing she has to be on top in this case. Which would mean that more than likely, she led him on instead of him dominating and forcing her to give it up. Which leads to this being CONSENTUAL SEX, unless Kobe said NO, which I doubt anyman would do in this case.

This will probably be the defense's arguement.

I heard he had the surgery after this incident. The 30th was the day he arrived in town and had surgery a couple of days later.
