Verdict Reached in Enron Trial

    This trial was bullsh!t because Lay should have been judged by a jury of energy company CEOs. Not the hippy windfarm company CEOs either -- BIG OIL CEOs.

    but on the Klansman example, should say an African-American be allowed on the jury, since his vote would be an automatic guilty verdict?

    wait...i saw the makeup of the jury in the paper this morning.

    there were two law clerks on the jury. one worked for bracewell & gulianni. the other was a clerk for a judge.

    there was a guy employed by Shell Oil's legal division

    there were two HR folks...one was an HR director. oh, and a payroll manager.

    there was an engineer.

    an owner of a fitness company.

    a principal of a school and two teachers.

    these are educated folks. certainly people capable of understanding the charges brought against these clowns. i'm not aware of what the charge to the jury would look like in federal court...but in state court its simple questions with yes or no answers.

    keep in mind, the prosecution alone doesn't pick the jury.

    In the Enron trial, max, the judge picked jury. I read it on Forbes.

    Again, why would a "jury of your peers" be determined by your profession? Is your identity dictated by what you do for a living? If Ken Lay was being tried for battery, would you say it'd have to be tried by someone in the same industry? If Juwan Howard was tried for shoplifting, should he be tried by basketball players? It makes no sense that a person should be tried by someone in the industry. Being in the industry, in fact, strikes me as something that should disqualify a juror as being too close to the case.

    The problem with professional jurors is corruption. You bring a citizen in every couple of years to do a case, they won't have an opportunity to work out how to make extra money out of it. If they do it 40 hours a week, they'll be as corrupt and jaded as our politicians.
