Austin lawyer Jamie Balagia is representing both Tarell Brown and Tyrell Gatewood, the Longhorn football players who were arrested early Monday with ex-Texas player Aaron Harris on drugs and weapons charges.

He told the American-Statesman Monday that both his clients were drug tested — at their request — to prove that the mar1juana that led to their arrest was not theirs.

“All in all, it was a weird set of circumstances,” Balagia said. “When the facts come out, this will be resolved pretty quickly.”

According to the arrest affidavit, Brown was arrested after deputies pulled over Harris in a traffic stop on Interstate 35 North just before 3 a.m. Brown was asleep in the back seat. Deputies saw a gun in his lap, and banged on the windows of the car to wake him. Balagia said the weapon was a “recreational gun” Gatewood had purchased two weeks ago for target practice. The report said it was a loaded 9 mm handgun. Balagia said that Brown had found the gun on the floorboard of the backseat and picked it up.

Texas Coach Mack Brown released a statement Monday.

“We are aware of the situation with Tarell (Brown) and Tyrell (Gatewood) and have met with both of them,” Brown said. “We’re working closely with the young men and the authorities. At this time, we are holding them out of all team functions as we gather as much information as possible before making a team decision.”

Tarell Brown and Gatewood were released from Travis County Jail about noon today, seven hours after they were arrested. They were released on a personal bond. Harris was released around 4 p.m., according to Balagia.

    Dumb dumb dumb.

I wish Mack would do some damage control with these players. Bring in a defense attorney and teach these kids how to stay out of this sort of trouble.

Keep your weed and weapons in the trunk, boys, and keep your mouth friggin shut!

I dunno. I can count the number of black Aggies I've met over the years on one finger. I can't remember ever meeting an asian Aggie.

Being a graduate of Texas A$M, you should fully be aware of indiscretions of your football program.

Your players have had their share of legal problems with the additional benefit of illegal booster payments which for many universities would have warranted the death penalty.

Do you think it's a coincedence that once the $$ stopped, your program began a slow and steady decline?

I think the coincidence is when Mack Brown and Bob Stoops came aboard to their programs and started the facilities war and RC couldn't keep up. That's when things started going bad. Hmmmmm, right after we won the big12 championship in 98.

And don't think y'all are squeaky clean. The burnt orange athletic department is quite impressive. I don't know what they do a better job of, putting quality teams out there or hiding the perks that go to the student athletes.

Facilities did you in? Laughable considering A$M has equivalent financial resources.

Your decline started before the 98 Big 12 championship team. That team was built on the 95 recruiting class which was built on the coattails of Jackie Sherrill's lawlessness. By the time you won the Big 12, your team was already heading south.

There was no way, without cheating, a conservative, white, traditional military school could ever attract quality African American kids to College Station when compared to the 3rd winningiest team in NCAA history and vibrant Austin.

What kind of car did Eric Dickerson drive before he got that better offer from SMU?

Texas was always "The" state school. UT had a national tradition built on championships and 10 win seasons before any of the SWC shadiness crept into our lives. We played the Alabamas and the Notre Dames and the traditional powerhouses in big bowl games.

Monetary incentives changed that for awhile (it was also no coincedence that Texas started to decline when every school in the SWC began paying their players, especially A$M, SMU, and TCU).

Now that everyone is on equal footing, A$M is back as a second tier sports program.

Make no mistake that Frachionne has won at every place he's coached. The fact he hasn't won at A$M is more indicative of A$M and not Franchionne. He just needs those boosters to come through again to be competitive.

This stuff happens when you recruit these types of players. Are these guys at UT even going to class?

    These type of players huh?

The ones that work hard on and off the field to bring the program it's first national championship in 25 years?

Single out these two players, but the rest of the players are clean.

Innocent until proven guilty jgreen91... read up on your constitutional rights biotch.

Unfortunately, a lot of the best recruits turn out to be "these types of players." Just look at past couple years:

    RT
    Tarell Brown
    Cedric Benson
    Reggie Bush
    Rhett Bomar
    Other OU guard
    Troy Smith
    80% of the Miami Hurricanes
    Maurice Clarrett
    Fred Rouse

As for Brown, I expect Mack to permanently dismiss him from the team tomorrow. Someone will replace him on Saturday and we'll move one. Not sure what his status is but I don't even think Brown can transfer and still have eligibility to play somewhere else.

I would guess that it will take Mack at least a week to gather all the facts, then he will probably be suspended for a couple of weeks after the OSU game. Will definitely be back in time for the OU game. ;)

Riet, that is one of the worst posts I have ever read.

Why should Brown have to transfer or be kicked off the team? As far as I can tell his only crime was to handle a gun in the back of a car (if he even committed it). Would a regular student be expelled from school for that? I doubt it.
