    My guess... this USSC will find a way to overturn Roe v Wade without having the decision blow back on them and fellow republicans. I think the justice's efforts to claim they are not partisan is being done in advance of this decision.

    How far back do you think this court will go back? 1950s? 1900s? 1850s?

    I guarantee that some states will turn around and mandate fossil fuels if they overturn the EPA rulemaking authority. We'll have 50 states with 50 different sets of emission standards on power plants. It'll be an absolute disaster.

    Solar and wind are price competitive with fossil fuels. The main issue will be how to satisfy the base load when wind stops or there are clouds.

    if only there were some sort of national nobody that could enact a common standard through legislation

    what's the difference between rulemaking and legislating? and why might SCOTUS gave a concern about the former?

    This court clearly favor State over Fed. If the court beat up on the EPA authority set by Congress, it won't just be fossil fuels fed regulation that is ditched, but everything that the EPA does including air and water baseline requirements. Will be a nightmare for our environment and the people.

    Yes this will be a big problem. While federalism is important pollution doesn't usually stay within state borders and as a matter of Interstate Commerce the Federal government should be able to regulate pollution.

    It's part of this anti-administrative state and agency rule making movement that many judges are promoting called non-delegation. If overturned, alternative solutions would be to go the executive order route (everybody's doing it, lol), or actually have Congress pass new substantive bills (which won't happen).

    1950's was a very progressive court. That one was on its way to see that poor people needed more protections until Nixon changed its makeup.
