Paying people as consultants who are working as employees is definitely illegal. While it's done a lot it's a big problem. As someone who does work frequently as a consultant and a subcontractor to other architecture firms and also brought in people to work for us as consultants / contractors it's one of the things that we frequently get warned about.

In the case of the Trumps it's doubly problematic given it's a private family owned business to then claim that family members are outside consultants.

 

Its not illegal and its not avoiding taxes. Ivanka pays more as a consultant than as an employee
