Not technically. Remember these are personal funds that were used by trump and not campaign funds. We have never seen personal funds being prosecuted by state law for a federal election. I hope the DA knows what he's doing here because he's stepping into the bright lights. Personally I'm not sure I would have prosecuted the case myself here. I think the Georgia and federal case are much clearer cases.
the update was about the statute of limitations question. Although there is some debate in the comments whether Knobel would apply in a future case to a resident who moves (as opposed to a non-resident from the start). No telling what a judge might decide on that issue
I think trying make precedent on a former president does not look good nevertheless. I'm not even sure the NY DA has jurisdiction over Trump because the doj has jurisdiction over federal elections especially when it relates to campaign funds. I want to see the full scope of evidence but Michael Cohen is an awful witness. I hope Alvin knows what he's doing cuz he's attempting to slay a drag with a knife.
The blog I was talking about didn’t speak to the merits of the case, but just around the question of whether limitations would bar the case. Sounds like that won’t be a winning argument for Trump.
