The victim described Bryant’s anatomy when asked about it at the party, the host said. Another friend gave a different impression of the victim, saying she was still “shaken up” by what happened. Luke Bray declined to be more specific out of respect for his friend and her family. “There is visible evidence of what happened,” he said. Eagle County sheriff’s spokeswoman Kim Andree declined comment on NBC’s report and Bray’s statement. Neither prosecutor Mark Hurlbert nor Bryant’s attorneys returned telephone messages seeking comment. Hurlbert has said he believes he has enough physical and testimonial evidence to prove the case beyond a reasonable doubt. The 24-year-old Bryant was charged with one count of sexually assaulting the concierge at an exclusive mountain resort last month. He said the sex was consensual and that he only committed adultery. The Los Angeles Lakers star is free on bond pending an Aug. 6 court hearing during which he will be formally advised of the charge against him. An Eagle County district judge has sealed most documents, including the arrest affidavit, details of the physical evidence and other information. The Denver Post, the Los Angeles Times, NBC and the Vail Daily have asked a district judge to release some of the material. Bryant’s attorneys filed a 23-page brief objecting to the release of any documents, the Times reported Tuesday. Bryant’s attorneys don’t want any negative information regarding him to be released to the media, fearing it would effect the trial, the Times reported. Lawyers for the Vail Daily and the alleged victim filed written arguments Tuesday in the newspaper’s request for police reports it believes are related to the woman. Hurlbert may file his own brief, spokeswoman Krista Flannigan said.
All these evidence point out there are reasons to "speculate" that Kobe might have commited an offence but none of the material-evidence above are daming enough to conclude that Kobe is a rapist. Unless there is a witness to confirm the development of events, and because of the nature of the offence, I doubt this is the case, there is room for Kobe's defence. It will, in the end, IMO, come down to "who is telling to truth". In this respect, Kobe and the girl's credentials will play important role. Reliability is a crucial issue. Despite the absence of logic, objectiveness, and intellectual tone in rezdawag's claim, he does raise important issue. Anyway, it is too early to make any judgement, IMO.
She does have a private attorney. If they (her family) play this correctly, they'll wait until after the trial is concluded THEN file their civil suit. This is exactly what the Brown family did to OJ. However, based upon that fact, I'm certain the attorney has advised them that there was no way that they could expect to keep her identity a secret.

I watched an hour long news program on CNN, including about 6 prosecutors and defense lawyers and Henry Lee ( LA Medical Examiner or forensics expert ). He was the only one who had anything intelligent to say. He said it will come down to which parties' story fits the forensic evidence the best, period. He did indicate the if there was bruising on her or skin under her finger nails that may clinch it in the jury's eyes. But, again we don't know at this time because the facts have not been published and the judge has already sealed everything. The lawyers talked and talked and admitted since no information except rumor and inuendo had been released that they couldn't really say anything for sure. It was a sham TV newscast. Question: Where were Kobe's three body guards ? Could they have testimony related to the affair. Would they go as far as to purger themselves to save Kobe's bacon, IF it is necessary. The DA says he has testimonial and forensic evidence. I posted it because rezdawg said over and over again there was no case whatever now that Kobe admitted to sex. He was either ignoring or didn't know about the alleged noise from the room, the hospital trips and the cab ride. No one here (that I've seen) has rushed to judgement except rezdawg. Did you not read the msnbc article I posted that had 5 people say that the girl was bragging about the incident and then describing Kobe's genitals to them? Secondly, If you read what I wrote, I said that bruising may be evidence of the crime also, but that it will be difficult to prove that it occurred as a result of Kobe's aggressiveness. As far as the alleged noise, ruckus in the room, hotel guest calling and complaining, etc... Thats all rumor too. Ive seen it on tv and on espn radio that those are bogus rumors. How did I backtrack my saying Kobe=innocent. And then saying Kobe will be found "not guilty"? I believe that if Kobe is innocent, that he will be found "not guilty". You went from saying that, based on your friend's say so, you knew him to be a good guy who wouldn't do such a thing and also that he was too goodlooking to ever want to to finally saying, well, you'll never prove it in court. You then asserted that the DA definitely only had DNA and the case was dead. Even leaving out the ho thing, you made an ass of yourself. You were the only one on the board pretending to know how this would turn out before any evidence was in (of course, I'm sure you're still convinced there isn't any). Further, you post hearsay assertions like the girl paying to bring Kobe food or today's party story like, whoa, there's trouble for the prosecution and THEN you dismiss anything that might be troubling for the defense as hearsay and innuendo. Depends on what they did. If my wife cheated on me with a 15 year old or my daughter slept with 23 guys in 17 nights while doing blindfolded handstands, then someone calling them those names would be fine with me. How could I argue against that?
