    This is capitalism at its best. If you have money(capital) you get your way. I am sure Adam is pround in his grave. :p

    How is this capitalism at its best? Capitalism is ultimately the freedom to barter private property. Eminent domain removes that freedom. Governmental regulations (ie. the power to confiscate) on private property smells moreso of socialism.

    This is an instance where the interests of big corporation coincide with big government. End result is the little guy gets screwed.

    I don't think this ruling should be viewed as partisan or ideological - it seems that both the conservatives and liberals on this board are united (for once) in their condemnation of it.

    I disagree. If I were having a "friendly fight" (I am interpreting that as a war of words) I would be happy to have Max as Referee. He has proven himself as a remarkably nonpartisan poster.

    Agreed. I am trying to talk my stepfather into running for Congress (in the GOP primary against DeLay) and the lynchpin of such a campaign would be a massive push to define some better boundaries for Eminent Domain. I thought the framers were very, very clear on the subject, but it appears that we need some clearer definitions in place.

    Proposal Made to Seize Souter's Property

    WEARE, N.H. - Following a Supreme Court ruling last week that gave local governments power to seize private property, someone has suggested taking over Justice David Souter's New Hampshire farmhouse and turning it into a hotel.

    "The justification for such an eminent domain action is that our hotel will better serve the public interest as it will bring in economic development and higher tax revenue to Weare," Logan Darrow Clements of California wrote in a letter faxed to town officials in Weare on Tuesday.

    Souter, a longtime Weare resident, joined in the 5-4 court decision allowing governments to seize private property from one owner and turn it over to another if doing so would benefit a community.
