    interesting that you left your hero george w bush out here...he lied us into a war that resulted in hundreds of thousands of deaths.

    right wingers keep throwing crap against the wall to see what sticks and this whole attempt to compare obama drone strikes to trump inciting an insurrection is just the latest blatant attempt at that. agree or disagree with what they did, there is no evidence that obama and clinton were acting in their own self interest when they ordered these things...trump was acting in his own self-interest in trying to steal the election. it had nothing to do with his job as president. you know this dude. youre just being partisan with this post.

    Even with Bush, who committed war crimes, I think it would be very hard to convince a jury beyond a reasonable doubt that any bad thing he did he wasn't doing in his capacity as president. Black sites, kidnapping, torture, war-mongering, illegal surveillance, violation of due process for American citizens -- he actually did all that stuff in a misguided attempt to protect the country. I certainly wouldn't mind seeing him tried, but I also understand why we don't indict him because those were official government crimes, not his personal ones. Trump's attempt to usurp power seems much more straightforward by comparison. He had only a small cadre of co-conspirators (plus a few thousand useful idiots) half of which weren't even in the official government. It can be demonstrated in court there was no credible fraud being pursued and that was just a fig leaf. And his personal benefit being sought is obvious. All presidents have done shady stuff. But none are as prosecutable as Trump.

    judge henderson has ruled favorably to trump on a few cases already, hence the concern she is the reason behind the delay in ruling:
    • In November 2019, Henderson indicated she wanted to revisit a 3-panel ruling allowing Congress to access Trump's tax records. The DC Circuit rejected her view by an 8–3 vote. She was the only judge to dissent who was not appointed by Trump.
    • In February 2020, Henderson joined the opinion of Circuit Judge Thomas B. Griffith when the majority held that the United States House Committee on the Judiciary could not enforce a subpoena upon President Trump's former White House Counsel, Don McGahn. Henderson wrote a concurrence arguing that the House did not have standing to sue here, while Circuit Judge Judith W. Rogers wrote a dissent. The full D.C. Circuit rejected this position on August 8, 2020.
    • In June 2020, Henderson joined the opinion of fellow Circuit Judge Neomi Rao issuing a writ of mandamus ordering a district court judge to grant a motion brought by federal prosecutor's asking that the criminal charges against Michael Flynn be dismissed. The district judge appealed[20] and after hearing the case en banc, the appeals court on August 31, 2020, ruled 8–2 against issuing the writ of mandamus, with Rao and Henderson joining each other's dissents.
    • On November 30, 2021, Henderson authored a unanimous ruling requiring the DOJ hand over more of the Mueller report, citing the Freedom of Information Act.

    I think the SC conservative judges would be motivated to take the case up *EVEN IF THEY INTEND TO UPHOLD IT UNANIMOUSLY* if for no other reason than to help him run out the clock.

    You can be sure that Clarence Thomas will argue hard to take this case up.

    And if the supreme court decides to take the case to save trump, it will be interesting to see how they pretzel their way around the following findings from the appeals court:

    re: trump's alleged crimes such as "Former President Trump’s alleged efforts to remain in power despite losing the 2020 election were, if proven, an unprecedented assault on the structure of our government."



    And around the impact/danger of granting amnesty to any President, and especially trump... "collapse our system of separated powers by placing the President beyond the reach of all three Branches"

    Dementia Don will next try to get the District Court to review this decision "en banc" by all of the justice of the District Court ... and then appeal to the USSC ... not because he thinks his case has merits but he is trying to run out the clock.

    Agreed. Hopefully the short deadline to file cert will help avoid too long of a delay by the compromised supreme court justices...

    He's getting close to being successful at his game. He really just needs a more conservative court that's willing to play ball and delay it. The SC was always a good bet to help him.
