Nobody on earth would have known whom it was if she didn't step forward. I've seen less grainy videos of Sasquatch (Toycen?). But of course she steps forward so she can get ridiculed and therefore have a reason to sue.
That sounds fair. Agreed. If she says something to the likes of "security peeps, I told you that was me in the video, and that I was embarrassed, and you still posted it (or didn't remove it when I asked you to)", I believe she has a good reason to follow through. Still, if it's "just to get money", frivolous suit is frivolous.
Exactly...how can she prove it was her in the video? The mall could say it was someone else and she is just some woman looking to get money. What a pathetic excuse for a human being...she looks like a dull, out-of-touch moron anyways, probably deserved it.

If you fall by accident or by your own stupidity, and security records you... and they use your video for YouTube and leave it up for millions of peeps to enjoy, yes, there is nothing to stop you. Satanism has churches too, doesn't it? :grin:
If I were the mall security company, I would take action against the employees, fire them if it doesn't violate company policy or state law, issue a public apology and statement that the company doesn't condone this behavior and it is not in line with the type of service we provide our clients. We thank Ms. X for bringing this matter to our attention so that it could be addressed, yada yada yada. Otherwise, she could drag their company through the mud in the media and make them look rank and amateurish to their current and potential clients.
I feel bad for initially hoping this happens to her again.. it's like certain human beings think they're above natural selection. If you're so oblivious while texting that you can't see the pole or the fountain in front of you, you deserve no money if you get embarrassed/hurt.
The more I think about it, the angrier I actually get. There are so many things at play here: 1) This b**** being so oblivious to the world around her while she's texting that she actually falls headfirst into a big ass ****ing fountain RIGHT in front of her. Most of us have gone through evolution, and therefore have enough periphery vision to at least sense that there is a giant water-spouting edifice in front of us that we are about to topple into. 2) Her being SO self-conscious of herself after her complete failure as a human, that once she realized this thing had been leaked onto Youtube, the first thing she does is contact a LAWYER. Any normal, rational person would watch the video, and think "pfft, that's so blurry....nobody would ever know that's me." Or hell, God forbid you LAUGH at yourself once in a while. Not her though. She's SO mortified that somebody in her little pointless bubble might recognize her that she feels like she deserves MONETARY COMPENSATION for being a complete, and utter imbecile. Forget the fact that she's obviously physically fine.....SHE WAS EMBARRASSED! Oh, the humanity! 3) The lawyer that she called just happened to be the biggest scumbag out there, and decides that THIS is what he's been put on this Earth to do. THIS is the claim to fame that he was destined to live out. I'm sure this guy sat in his apartment at law school and got off on watching his VHS tapes of F. Lee Bailey getting O.J. Simpson acquitted, and thought to himself "now THERE'S something the world needs more of...." To him, the ends ALWAYS justify the means. What do you mean there's such thing as professional and moral responsibility?? Some dumb b**** just fell in a fountain!!! Time to get rich!!! Excuse me while I go pop some Tums....the ulcer that I have from this is flaring up.
You know what's even worse? Good lawyers take stupid cases like these, while innocent people on tril get stuck with ****ty lawyers.
Actually there are other ways to verify her story. The most viable way I would go at it is the feed in the video appears to be the malls primary security video feeds that cover the concourses and such. These are most likely not the only security feeds covering the mall as more times than not when a store leases a space in place such as a shopping mall they contract and install their own security cameras as well for additional security. More times than not these stores will have a better quality security camera network which will provide a better image. Now given most stores will cover their entrances as well as their actual shopping area you will have a pretty good chance at capturing her movements in and out of stores and possibly through the concourse during her time at the mall.
