No. You can lay off basically for no reason (just say you eliminated the job position). There are many wrong reasons for firing a person. Discrimination- this is all the reasons most people understand race, sex, creed, disability etc etc Retaliation- this is the one that can nail an employer, even in Texas, you simply cannot be terminated for reporting illegal or unethical business or any whistle blower activity. Defamation- If you can prove that your employer deliberately falsified information or attack your character, used false charges etc to terminate. If you are royally screwed by a company and you can afford an attorney you have a decent shot at a lawsuit. Now the flip side is if they have documented proof of poor performance or policy violations... then you are screwed.
Just to clarify- yes, you can be fired without cause, but most employers who do that don't have an educated workforce. Large employers are very leary of doing this.
It happened before to my CPA mother in law who worked for a major company. She has done the taxes for many of the Rockets players and celebrities. One day at a previous company she was let go and was never given any sort of reason even though she asked and asked.
That's sounds like a rip off!!! But I realize it happens every day. Technically that termination could have been challenged and changed to a lay off. Termination due to reduction of work force or lack of work or most normal reasons other than poor performance, or policy violations are eligible for unemployment. I hope she got unemployment. When you are fired you are not eligible for unemployment in the state of Texas.
