    This kid should go to jail and be banned from driving until he is 21.

    A bit perplexing why he wouldn't be charged. At least a reckless driving or criminal negligence or something.

    I suppose he can still be sued by a half-dozen parties. That's something.

    Not sure I understand how someone who is old enough to drive isn't old enough to be tried like any other adult when assaulting others with his vehicle.

    "Rolling Coal" is the among the dumbest things ever. This kid deserves to do time and his parents deserve to be sued six ways to sunday for raising such a rude and inconsiderate kid who could have killed the bikers.

    What an *******. I would have no issue with anyone "rolling coal" getting kicked in the nuts by anyone who witnesses it. What is the appeal?

    KPRC 2 has learned that a special prosecutor has been named to a case involving a teen driver accused of hitting six cyclists in Waller County.

    Warren Diepraam will be handling the case. He is the former first assistant for Waller County District Attorney Elton Mathis and is an expert in prosecuting vehicular homicides. Diepraam also handled the high-profile Sandra Bland case.

    100% positive this is a rich white kid. Any minority dumb enough to drive illegally and run over 6 people will b sent to juvvie or tried as an adult.

    Rick DeToto, a Houston lawyer hired by the teen’s family, called the boy “inexperienced” and characterized the crash as serious but not prompted by someone out to commit mayhem.

    “The police did an investigation at the scene.,” DeToto said in an email. “This included speaking with eyewitnesses… After their investigation they decided not to charge my client and did not issue him a traffic citation. Clearly, they decided a crime had not occurred.”

    Ultimately, Mathis has said that decision likely will be decided by a grand jury or the juvenile justice system once police finish their investigation.

    Many online and in phone calls to Waller officials have speculated that police would have acted differently if the teen had used a gun or knife to harm others as opposed to a motor vehicle. Others have suggested the county’s close-knit politics may play a factor.

    Mathis disputed those allegations in a post Tuesday.

    “The lead prosecutor on this case is in communication with the Waller Police Department and gathering information from them as they make it available,” Mathis wrote. “We are also aware of the identity of the juvenile and can guarantee that from the perspective of this office he will receive no favorable or unfavorable treatment based upon who his family may or may not be.”

    The attorney for a 16-year-old who ran over six cyclists as they trained outside Houston claims the teenager is a "new and inexperienced" driver who had no criminal intent, despite witness accounts saying he was harassing the group of bikers with a modified pickup immediately before the collision.

    Reached by phone Wednesday, the teen's family referred questions to Houston attorney Rick DeToto, who responded via text:

    "My client is a young man in high school with college aspirations. He’s a very new and inexperienced driver. This was a serious accident but did not involve any criminal intent. He immediately called 911, helped with the injured and cooperated with police. The family prays for the speedy recovery of the riders involved and we look forward to cooperating with investigators."

    DeToto declined to answer follow-up questions, including whether or not he is refuting claims that the teenager was intentionally blowing thick exhaust smoke onto cyclists before the incident. Waller County District Attorney Elton Mathis, through a Facebook post and interviews with TV reporters, hinted that the teen could face charges ranging from misdemeanor assault to felony aggravated assault with a deadly weapon. Ultimately, grand jurors will decide if charges will be filed, he told ABC13's Steve Campion.
