The kid in question is 17. There is no reason for that to be a crime. Yes, the teacher should lose her job and probably her license, but that's as far as it should go.

A few years after I graduated high school, one of the male teachers there was dragged into a rumor by some cowards that he had an affair with one of the athlete girls. I don't think it was ever proven, but it was enough to get him fired and ruined his life. Teachers like the one in the OP is ruining it for innocent teachers that were just victims of false rumors. If things like these (teacher-student secks) wasn't so normal nowadays, the teacher from my old high school could still have a job and a normal life.
The guy at your old high school didn't lose his job because of how common these student-teacher relationships are. He lost his job because he's a man. It's women that are always getting away with it.
