    and death threats are taken seriously

    what you think public death threats garnering attention of these maga militia who are on stand by?

    That's interesting and also disturbing. A lot of people say threatening things all the time as in the article it notes that Eminem rapped about killing his ex wife, heck we've had people here on CF.net talk about killing public officials or at the minimum wishing them death and other harm on them.

    What I'm curious about is the term "true threat" that the court was looking at and how that get's interpreted. In this particularly case can DiGenova's statement be considered a "true threat" against Krebs? I'm guessing that means the likelihood that DiGenova would actually carry that out.

    That is such a classic case of "when keepin it real goes wrong", lol.

    For serial tho -- this area of the law is so squishy to the point it's almost indiscernible.

    Musing out loud that someone should be put in jail, shot, etc would probably not constitute a "credible threat" but, depending on your celebrity status saying something like that can be horribly irresponsible to the point it may be wreckless, incitement, etc. Not sure a court would agree with me, and also not sure I'd want them to agree with me.

    or howbout he can convince/incite these white extremists/militias/maga soldiers/proud boys who are on stand by?

    he may not be officially in the govt but he's not simply a random private citizen

    Incitement is an even vaguer area of the law it seems.

    You're probably not going to ding any of these people in court for grumbling out loud about what they feel 'ought' to be, as disgusting as those thoughts are.

    Legislating that people not be assholes is tricky terrain.

    I'm not sayin its a slam dunk case. I'm just saying it's definitely worse than what some people here make it ought to be.

    And this is not only some random guy is grumbling out aloud to himself. He as a lawyer for the POTUS is declaring this to the POTUS cult of millions and a portion of them are on "stand-by"

    This ******* should be arrested, and if found guilty, thrown into jail. In my humble opinion. He says it was "a joke." I don't believe him, and in the unlikely event that he was joking, far too many will take him seriously. Guys like this are putting real people, including their families, in real danger

    The whole it was just a joke thing is a hallmark of the alt-right, the Proud Boys, the President, and conservative idiots everywhere. They say an outlandish thing to deliver their message, get blowback from the normal people, and then claim it was a joke. Nothing new here.
