    Cool that Clutch added the standings section.

    Going into tonight's game, Rockets are 1/2 game up on Denver, tied with Seattle and 4 games behind Phoenix. If the Rockets can finish February about the same in the standings, I think we'll be in excellent shape. Assuming the weakness of schedule ratings still hold, the Rockets might have a real chance to catch up with Phoenix, leave Seattle behind, and hold a slim lead over Denver. Crossing fingers.

    Variations of this have been done over and over again, though Smeggy started it all in his thread. Since my title is the coolest, I'm going to just respond to this one though. [​IMG]

    Also if/when you look at the table, notice that there are other things that aren't captured by the numbers here at this time(though it's obvious that the Rockets have the easiest schedule over the next few weeks). For example as crash pointed out, Dallas' schedule gets ridiculous around March 15th.

    This table, and hopefully the Rockets record at that date, will show the Rockets to be a sure-thing for the playoffs.

    I expect to see a summary of this thread in the Chronicle in a couple of days. Great post Achebe.

    Oh yeah, "International Copyright Law" has no bearing on SmeggySmeg rights as U.S. Federal governs works created in the U.S. However, Achebe's right, once improved on the improved work becomes Achebe's. Don't worry though, SmeggySmeg, you still have a copyright on your original work.

    A great post by Achebe. Great graph. Clearly shows the Rockets schedule as compared to the rest of the compatition.

    Suns, Mavs and T-Wolves may be in front, but the Rockets have the inside position and are ganing fast!

    Is Smeg's work considered created overseas or in the US? He might have typed it in Australia, yet it did not come into being until it passed through the UBB software on a computer system in the United States.

    Please clarify this point.

    First, I have to apologize for my original posting. It may only kindly be categorized as completely incomprehensible.

    That being said, I hope this helps. This ain't legal advice, just a summary of what I found. Here's the dope:

    First, it might be instructional to figure out which country's laws apply in this case.

    All authors living in participating countries automatically receive copyright protection in all other countries that are parties to the Berne Convention for the Protection of Literary and Artistic Works, or parties to the Universal Copyright Convention (UCC). Most countries belong to at least one of these conventions. The U.S. and Austrailia belong to both. Members of the two international copyright conventions have agreed to give nationals of member countries the same level of copyright protection they give their own nationals.

    Works of foreign authors who are nationals of Berne or UCC-member countries automatically receive copyright protection in the U.S. Unpublished works are subject to copyright protection in the U.S. without regard to the nationality or domicile of the author.

    To boil it down to the nitty grit, Achebe is not subject to the laws of another country (i.e., the copyright laws of Australia) when an action is taken outside the jurisdiction of that country. However, since the U.S. is a party to the Berne Convention and the UCC, Smeg may choose to enforce his rights in the U.S., the location of the alleged infringement. In enforcing his rights, Smeg will be subject to the laws of the U.S. As stated, to bring an action against Achebe in the U.S., Smeg would receive the same protection that a U.S. author would under the Copyright Act.

    Now we know that U.S. law applies, here's what U.S. law has to say about Smeg's original creation.

    According to Section 101 of the Copyright Act, a work is "fixed" when it is made "sufficiently permanent or stable to permit it to be perceived, reproduced, or otherwise communicated for a period of more than transitory duration." It makes no difference what the form, manner, or medium is. An author can "fix" words, for example, by writing them down, typing them on an old-fashioned typewriter, dictating them into a tape recorder, or entering them into a computer.

    Smeg's work "came into being" (i.e., was "fixed") the moment he typed it in Australia. Thus, it "came into being" as he typed it in Australia, not when it was stored on a server (presumably in the U.S.) or viewed on the BBS (worldwide). As stated, publication is not a requirement for enforcement of rights in the U.S. (the jurisdiction Smeg would have to submit to in enforcing his rights). Hence, as I stated in my original post, "International Copyright Law" has no bearing on SmeggySmeg rights.

    By the way, most of this information can be found at FindLaw.com (Copyright 1999, Ladera Press). That's where I confirmed what I learned in a class I took in law school.
