So hypothetical, here: A guy shows up at a public place and pulls a gun. He starts shooting. An off-duty police officer is there but does nothing. His excuse is "Hey, I'm off duty. I'm not doing anything". You think that will fly with his boss or any of the people getting shot at in that place? Sure, the situation is a little different, Foley didn't have a gun. But does that really make a difference to the people he could have potentially hit head on? Police officers take an oath "To Protect and Serve"; not "To Protect and Serve only when I'm on duty" or "To protect and Serve when it Strikes my Fancy". It shouldn't be a question of why the "Off Duty" officer tried to stop him, but why the hell was Steve Foley driving with a BAC of 0.233.
Actually, I was talking to a cop friend about this the other day and he said the cop messed up big time. An off duty police officer must call in any attempt to stop a vehicle and CANNOT make a stop. They can chase the car until a marked car comes to make the stop but they simply cannot make the stop. So, yes. They protect and serve when they're on duty. This cop friend has told me that I should never stop for an unmarked car. The police will always have the stop made by a marked police vehicle. How was Foley supposed to know that the guy was really a cop? Because he flashed him a badge? I wouldn't stop for any old guy with a badge. I'm not excusing Foley's drinking and driving but the cop here messed up. Why chase the guy for 10 minutes and not call in for backup?
I totally agree with that. You shouldn't stop for an unmarked car. You can buy those badges at Party City along with the Hot Copette uniform. Both parties are at fault and the cop should be punished for overstepping his boundaries too.

Police may never be entirely off-duty. There's a reason many police departments still require cops to carry their weapons while off-duty. What do you think happens to them if they see a crime in progress (particularly one that threatens lives such as drunk-driving) and they do nothing? I'm just amazed that anyone thinks that it's bad that a cop, on or off duty, got some drunks off the road before they killed someone.
