I think that's a typo. The Sexual Assult is minimum 5 to life. If it were a Hate Crime it would be minimum 15 to life.
No, it was a poorly worded sentence. I think it meant to convey anywhere from a minimum of five years up to a maximum of life in prison...based on a jury recommendation and the judge's final sentence. Edit: Dangit, oomp
Typically there's a sentencing part of the trial after the guilty verdict is rendered where witnesses are called and what not. Sometimes this is decided by the jury, sometimes the judge. I'm not sure who decides which type of cases.
