That applies to the Third Convention. The Fourth deals with treatment of civillians in a war zone. The US as a signatory is bound by them even if the insurgents haven't agreed to them. This was discussed a lot with the Abu Graib situation where Rumsfeld and pretty much everyone in the chain of command said that the Geneva Conventions apply to Iraq.
