I think Pappas speaks directly both to basso's accusations that Sotomayor is an opponent of free speech as well as the Ricci judgement. Clearly she did not allow the race of the defendant to color her judgement in Pappas.

Another in the continual (amusing) attacks on Obama, in this case on Sotomayor by employing concepts and values of the left. It shows the complete intellectual bankruptcy of the right. They showed that they could give a *uck about free speech or constituional freedoms if it was trampled on by their beloved Dubya and Cheney or alledgedly in support of our military security or just to promote hatred of Muslims.
Having not read the opinion, it appears that Sotomayor's ruling implies that the child has every right to call the school officials douchebags. Conversely, the district has the right to exclude her from school activities, including student government. This is a very strict interpretation of the First Amendment. The First Amendment does not say that you can say whatever you want and insult whoever you want without fear of reprisal. If this is what Sotomayor was implying, then she got it correct. Yet another non-issue.

I was going to cite that case also in response to the argument that Sotomayor isn't a friend to free speech. From what I've seen so far of Sotomayor's record I'm not sure anything definatively can be said regarding her rulings and it does seem like she isn't an ideologue either way.
