actually they do, this is taken from the Texas transportation code: ยง 552.008. DRIVERS TO EXERCISE DUE CARE. Notwithstanding another provision of this chapter, the operator of a vehicle shall: (1) exercise due care to avoid colliding with a pedestrian on a roadway; (2) give warning by sounding the horn when necessary; and (3) exercise proper precaution on observing a child or an obviously confused or incapacitated person on a roadway. there is more but look up section 552 and you'll find the answer, i dont want to post it all, and even if you do hit a pedestrian who was jaywalking, who do you think the judge will favor? i know a person who got hit while jaywalking, sued the driver and got a lot of money, and if I'm correct court decisions are also a part of the law, Law 101- 1- Constitutional law 2- Statutory law 3- Court cases
in states like texas, yes. in cities like ny, no. its very common to pedestrians and bikers to 'jaywalk'. its part of the culture. no they wont just JUMP infront of a moving car, but if they think they can make it to the other side without making a car slam on their brakes, they'll walk.. its very normal. in fact, jaywalking is a SKILL, non new yorkers have trouble timing their jaywalks..
Just to make it clear, I did not come close to hitting her from what I now remember. She kicked my car after the nose and front door had already been through the crosswalk.
yes invite her to tea as one of the other posters suggested. I'm taking that literally, I'll just ask her if she wants to have afternoon tea with me if I provide the crumpets. I just want to see her reaction.
