The ACLU and other groups are prepping lawsuits against the EO. Based on past history it’s likely those suits succeed because an EO Doesn’t have force of law. The same thing happened to Trump when he did similar moves under an EO. It just happens that lawsuits take some Time to be written and heard in court but at most this EO is a temporary solution. Only an act of Congress can address the issue long term.
