Brandy Burning was pulled over for driving in an HOV lane. During the traffic stop, she informed the officer she was recording their conversation. The officer, Lt. William O’Brien, told her that recording him was a felony and demanded her phone. When she refused he forcibly removed her from her vehicle and arrested her. She suffered bruises and scrapes during the incident.

After spending the night in jail, she was released and all charges were dropped. Her lawyers have informed the Broward Sheriff’s Office that she intends for sue the department over the incident.

While I do think Americans are sue happy and that damages awarded are often ridiculous, there are times when it is deserved. Im sure her vehicle was impounded. Providing there are not more details to the story, the office clearly overstepped his boundaries.

It's NOT illegal to record police during a stop. You don't have to inform them either. They just don't like it. If the story truly happened as advertised, the officer should be suspended and the precinct should be sued. Can't just throw people in jail. It's very inconvenient. The woman's car could've easily been damaged at the impound causing $1000's in damages, the hassell, etc.

Sadly, the only "change" that will come out of this will probably be proposed legislation to make recording in public illegal.

    Nothing sad about that.

It should be SOP that LEOs record all encounters and the public should have the same right (without informing the officer).

That cop is a disgrace to his profession. What a lying, insecure loser.

Lol you're not supposed to tell the police you're recording them. Obviously they'd get pissed

What about if the cop actually knows her?

They staged the incident in order to give her a free ticket to sue the government for big bucks?

If the police force went out of business what would cops wind up doing? Think about the jobs they'd wind up at. Walmart, Whataburger? They shouldn't be called cops, they should be called regular ass people with guns and patches on their shirt.

Illegally driving in the HOV to avoid traffic. Was probably being a massive B because she got caught. Spent a night in the tank. Good luck in your lawsuit.
