If gay marriage is illegal because of what little the Bible says about homosexuality, then adultery should absolutely be made illegal for the same reason. It is after all one of the ten commandments. Of course, I believe that the government shouldn't adopt Judeo-Christian laws just because they're in the Bible. (I'm a Christian BTW). And I'm willing to bet that there's a significant number of lawmakers that are guilty of infidelity themselves and that they'd never allow such a law to pass.

I teach a law and ethics sequence and the first thing I do is hand out the Alligator River Story. Basically this girl needs to get to her love and the only way to do so is by a riverboat. The captain says she must sleep with him to get across. She does and then her love shuns her when he finds out. She tells this to a friend who goes and beats up her now former love. It's a story designed to point out the difference in ethics and law. I ask the students to rank the characters from most to least honorable. Everyone puts the girl as the worst but never the guy who beats up her lover. In the real world the real crime here is assault and battery but everyone ranks cheating as worse. I point out to my students that it is interesting that everyone feels cheating is worse yet it's not illegal. Creates for interesting discussion.
Mentally and emotionally abusive spouses probably love this idea. Marriage is not surgery or a shuttle launch; nobody dies if it doesn't work out.
