    I believe it is still illegal in some places and I bet most states had a law against adultery at one point or another. The statues have slowly gone away as they were rarely enforced.

    Just because a particular act is wrong does not mean it should be illegal.

    Intercourse? Foreplay only? What about non-penetration? What about non-sexual companionship (i.e. simple dating as friends)?

    I guess it depends on what the definition of is is.

    It could never pass Congress because so many members would have to recuse themselves from the vote because of conflict of interest.

    cheating is wrong but there is no way to prove it on a government level if it were illegal. The courts would be flooded with cases that were word of mouth. people cheat all the time and they can handle it themselves that's what divorces are for most of the time. one of the two or both are cheating and they file the divorce as "irreconcilable differences," if i got cheated on i would just leave the person and move on **** once a cheater always a cheater.

    Nope. As I've said before ideally I would like to leave marriage up to contract law and take it out of the state's hands. The last thing I want to see is more intervention.

    The issue of child rearing is probably the heaviest reason to push for the illegalization of cheating but, in my opinion, current child support laws sufficiently handle it.

    You want a marriage to stay together? Take away divorce.
