[Serious] How to Break Contract with Real Estate Agent?

    Currently have a property that I am selling. Not too happy with the real estate agent nor the agency that I signed up with. How do I get out of the contract and what are the ramifications? I don't care how much it costs in all honesty, I'm willing to goto court and pay them a few grand to get their grubby hands off my property at this point. Just hoping you guys might know something that could save me from going that route.

    Anyways how far are you in the process? Have you started to close? Have they listed. Might have to pay advertising.

    real estate agents... get paid more than people who actually build the freaking house for just signing some papers.

    There are no standard practices to cancel an agreement. You will need to read your contract first.
    What you dont want to do is breach the contract outright.
    You should first speak to the RE Broker, explain your reasons why you want out. Have your terms ready, whether youre willing to shell out a couple hundred bucks or refuse to sell or if they are willing to meet your expectations.

    You have the leverage. While they have the right to list the house and collect a commission, you can say no to every offer and never let the house sell. You can be at every viewing and bad mouth the broker and tell the potential buyer you will not sell with the current broker listing it.

    At worst, they should take a couple hundred dollars to go away. At best, they let you out. If you sell outside of the process, they WILL sue for a commission.

    We are a few months into the process. No closing yet. I don't mind paying for the advertising fees. I just don't like how they conduct business

    yeah I wanna do it legit, have no issue with paying up to a grand to get rid of them. my lawyer would hit me up for that anyway if I had to goto court.

    Okay then well you shouldn't (not your attorney) have any issues in canceling your contract. Just email them and say you want to part ways. The broker might want you to switch agents but you also can just postpone your selling and want out of the contract. Most are 1 year right to sell but I don't know too many agents wanting to represent someone who doesn't want them for service.

    Sounds like the mentality a lot of ignorant sports fans (all over the world) have about sports agents.

    Call the broker or office manager .... Have a legit reason for breaking the contract.

    right... you can't compare the two. unless it would work as if the sports agent got paid more than the athlete for his services.

    The RE agent model has turned into something that closely represents a used car sales lot. The GIS, tax records online and an online MLS have made the buyers agent process obsolete. Since the market has crashed, the RE agent pool is full of inexperienced agents who believes the gist of their job is to let people into the house and get you to buy any house so they can get their commission. 2-3% of list price is a steep price to pay just to simply push in a code and let me in...and then do secretarial work if I do choose to buy.

    Fair point. (Does happen in some sports though but usually by the unscrupulous ones).

    You are surrounded by horrible realtors...

    If you want to terminate the listing, just have them draw up the Termination of Listing paperwork. If you're not in closing and you don't go behind their backs to sell to someone they put you in contact with, it shouldn't be a complicated process. There may be some fees, but it's best to terminate a relationship you are not happy with as soon as you can.

    Or have tons of time on his hands. We're in the middle of selling our house and buying a new one. Our agent is certainly earning his commission taking care of things that either we wouldn't have known about or wouldn't have the time to take care of ourselves.
