    Again, I don't know one way or the other, but understand at least that there is a difference between 'public intoxication' and 'driving while intoxicated'. IE, for a DWI, you must take a breathalizer test and have a bac over the legal limit in order to be charged with DWI, OR, you must be clearly impaired by alcohol while driving, directly witnessed by the officer, even if your bac is still below the legl limit. (Try to guess how often THAT happens). Anyway, for 'public intoxication', there is no breath analysis test, no criteria used other than that the officer 'thinks' that the person is intoxicated. It does not indicate one way or the other whether or not his bac was above or below the legal level, nor does it indicate one way or the other whether or not he was impaired regarding driving a motor vehicle.


    In other words, he MAY have been too drunk to be driving, but he may also not have been. Chances are, he never took a breath test with this episode, because he was not driving, and therefore would not have been required to do so. So we will, in all likelihood, never know just HOW intoxicated he was.

    So don't just assume he was legally or functionally impaired. The criteria for the two charges are vastly different.

    I would think that generally, if a "fact" is unable even to stay on Wikipedia, it may lack credibility, especially if there's no other source for it.

    From what Nero was reporting, this isn't going to be that big a deal. The Rocks may take a bit of a hit on a potential deal, but I can't see this being a deal breaker. IMO, he may have cost us a 2nd round pick, one way or another. And I have nothing but a hunch to base that on. :D

    If that's the case, then Rafer was wrong but let's be real here, it's not like this isn't commonplace downtown. Personal experience tells me that anybody can get towed anywhere anytime.

    This is true, cops can toss anyone into the slammer for PI...not much proof is needed.

    It is purely a judgement call by the officer, and we know how accurate those can be some times.
