    Taylor to accept subpoena.

    A lawyer representing freshly subpoenaed Sara Taylor, the former Rove deputy and White House political director, said today he “would accept the subpoena issued by the Senate Judiciary Committee in the firings of eight U.S. attorneys.”

    Seems the WH has "discovered" that they have the 5 million missing emails afterall.


    Today, during a Senate Judiciary Committee meeting, Leahy revealed that the White House does indeed have the emails, but has yet to turn them over to Congress:

    Now that their claim of “lost” emails has been proven false, the White House must turn them over to Congress. Claims of executive privilege are not sufficient to deny these emails to congressional investigators as the use of “Republican Party-sponsored” email addresses significantly undermines any claims to such privilege.

    Bush’s Scandal-Ridden DoJ Nominee Withdraws Over Fear Of Senate Fight

    William Mercer, the Acting Associate Attorney General, asked President Bush today to withdraw his nomination to be the permanent No. 3 official in the Justice Department, “saying it was unlikely that the Senate would confirm him to a post he has held on an interim basis since September.”

    Mercer, who is also the current U.S. attorney in Montana, is enmeshed in both the U.S. attorney scandal and the politicization of the Justice Department. He reportedly told fired U.S. attorney Daniel Bogden of Nevada that his dismissal was “to make room for others to gain experience so the Republican Party would have a strong bench of candidates for federal judgeships.”

    Sen. Jon Tester (D-MT) called for Mercer to resign after the Washington Post reported that he “worked to alter federal law so that he and a handful of other senior Justice officials could escape residency requirements that governed their assignments as U.S. attorneys.”

    In a statement, Sen. Patrick Leahy (D-VT) said Mercer withdrew his name to avoid testifying under oath:

    The White House has found many ways to keep sunlight from reaching some of the darker corners of the Bush Justice Department, but this is a new one. They have withdrawn this nomination to avoid having to answer more questions under oath.

    Gonzales said in a statement today that he is “very pleased that the department will continue to benefit from his leadership, talent and experience through his role as U.S. attorney in Montana.”

    Mercer, whose confirmation hearing was set for Tuesday, has served for two years as the Acting Associate Attorney General.

    I'm sure it's just a coincidence.

    William Mercer, the Acting Associate Attorney General, resigned on June 22, 2007.

    Michael Elston, chief of staff to Deputy Attorney General Paul McNulty, resigned on June 15, 2007.

    Monica Goodling, Alberto Gonzales' White House liaison, resigned on April 6, 2007.

    And what do all of these dates have in common? They're all Fridays. (And, in each instance, the resignations were announced in the late afternoon.)

    The Late-Friday-Media Trick has been around since before Bush took office -- release embarrassing news when it's least likely to get noticed -- but no White House has ever been this shameless.

    Bush won't supply subpoenaed documents

    WASHINGTON - President Bush, moving toward a constitutional showdown with Congress, asserted executive privilege Thursday and rejected lawmakers' demands for documents that could shed light on the firings of federal prosecutors.

    Bush's attorney told Congress the White House would not turn over subpoenaed documents for former presidential counsel Harriet Miers and former political director Sara Taylor.

    In reaction, Senate Judiciary Chairman Patrick Leahy accused the administration of shifting "into Nixonian stonewalling" and revealing "disdain for our system of checks and balances."

    "With respect, it is with much regret that we are forced down this unfortunate path which we sought to avoid by finding grounds for mutual accommodation," White House counsel Fred Fielding said in a letter to Leahy and the chairman of the House Judiciary Committee. "We had hoped this matter could conclude with your committees receiving information in lieu of having to invoke executive privilege. Instead, we are at this conclusion."

    Thursday was the deadline for surrendering the documents. The White House also made clear that Miers and Taylor would not testify next month, as directed by the subpoenas, which were issued June 13. The stalemate could end up with House and Senate contempt citations and a battle in federal court over separation of powers.

    "Increasingly, the president and vice president feel they are above the law," said Leahy, D-Vt., after getting the news from Fielding in an early-morning phone call. "In America no one is above law."

    WH is betting that they made enough Bushie appointments in the federal courts to block any serious investigation of themselves.

    What happens if say Democrtas starts investigation after a Democrat president takes office in 09?

    It is not like they are going to impeach Bush now. So the only thing we are talking about is firing Rove here.
