I was rear ended near an intersection, and the other driver claimed he left his wallet in his other vehicle. I got his license plate #, insurance, and telephone # (called on the spot and it rang). Was on the way to work and didn't call 911 (lol herp derp) Turned out, he cancelled his insurance a while ago and now I'm just left with a plate number. Actions I've taken: -filed an accident crash report/police report the same day -called DMV, registration renewal process is automatic and they can't bar renewal -called Texas Department of Insurance fraud line, who only deals with insurance companies and not individuals -called police again, who told me it's now a civil matter and I have the option to look up his license plate info at the Harris County Records and sue him personally Lawyers of Clutchfans, what are some of the actions I can take right now? Besides signing his phone # for Daily Cat Facts. Lesson learned: always call 911, regardless of how small an accident is.
What does your insurance company have to say? Can't you ask your agent to contact the other driver on your behalf?
I think, and I'm no lawyer, that your insurance company (if you have full coverage) will take care of your claim and sue the negligent party for you. You still probably have to do some ground work like looking up info in county records.
Depending on the amount of damage, your choices are pretty much: - Eat it, hope you have a small deductible or uninsured motorist - Track him down from his license plate and sue The only thing calling 911 would have done is running his plates, ticket him for failure to control speed. Maybe find out that his insurance wasn't up to date and ticket him for that. You probably should have gotten his address from his Driver License and his DL# as well. But all of that could be out of date or fake as well. Getting your repair fees would always have been a civil matter.
Answer is simple. Hunt him down while he is driving and rear end him back. Since he has no insurance he will be too scared to call the police. Drive away fistpumping.

That sucks. Definitely sic your insurance company on him. You have to report the accident to them, but hopefully they don't raise your premium over it. If you want to keep it off the books, it'll take a lot of leg work on your end. Driver claimed he didn't have his wallet on him.

I was hit by someone who ran away. He didn't have insurance so I just had to pony up my $250 deductible and insurance paid the rest itself.

Welcome to the club! Give the info to your insurance company. They can attempt to sue him on your behalf to collect monetary damages. They will try to recoup to cover their costs first, however. If they are unable to collect, then you can sue on your own. My insurance company didn't collect a penny. They usually try to get his license revoked or suspended in these cases...but you would never hear the outcome except they were unable to collect any money (that's all I got from them). Just pay your deductible and bite the bullet is probably where you are headed. That's the screwed up system for you. Someone hits you driving uninsured...and you lose.
Car accident story... when i was in NJ...this older lady lost control of her vehicle and started to swerve on I-78...she ends up clipping my front right sided fender and bumper leaving a significant dent...After we pulled over to the side...I went up to her to make sure she was ok...She ended up being an old lady, and didnt speak much english...she seemed genuinely frightened...Then luckily for me...i turned on my phone camera took pictures and started recording everything that was said...I then called my dad to ask if i should call the police...he said just do it...just so you have documentation of the incident and can be used later on in court... Then i took a pic of her license, insurance and plates... After i called the cops...i waited for about 45 minutes for them to come...in the mean time...her two smoking hot twin granddaughters came up to the scene, made sure their grandma was ok...and then they started to try flirting with me and seeing if i would not call the cops...after i shattered their world...telling them i called the cops...they went back to the grandma... The cops finally show up, and go to her and get the info, and then come to me...they tell me that the lady accused me of causing the accident by hitting her on the rear left of her vehicle...then i pulled out the recorded conversation i had on my phone and let the cops listen to the conversation...and lo and behold the lady was coached to lie by the 2 twin females... So two main lessons to learn....1. start recording stuff the moment stuff happens, especially conversations...2. always call the cops just to generate an incident report...its up to both parties to decide if damages are worth enough to file with the insurance company... Turns out...she had an expired insurance, and was sued by my insurance to recoup damages...oh and dont trust people regardless of how innocent, sweet looking, or hot they might be...
From everything I've heard, it's recommended to NOT contact my insurance, as it will only raise MY premium even when I'm not at fault, and insurance will do nothing to fight for me. I see zero benefit in doing that. I'm tempted to go to the legal route and file a small claims case. The damage on the bumper was quoted for $600, excluding the 3 days it'll be in shop where I'll need another vehicle.
