Something similar to this happened to my family about 25 years ago. My grandparent's home was being robbed - the thieves had a van pulled up in the driveway and were going back and forth through the front door. My grandparents pulled up in the middle of this and foolishly ran up and confronted the robbers.

Thankfully the robbers wanted nothing but to get the hell out of there -- as they yelled to the guys in the house to get out the neighbor came running over with a shot gun. The robbers took off and just as they were hitting the street the neighbor fired into the driver's window. The van lurched and drove up on another lawn -- slowed for a second then took off again as fast as it would go.

No one ever found out what happened to the guys -- they were never caught, but the driver had to have been seriously hurt and possibly the passenger as well. The neighbor was never charged with any crime, but obviously the Horn saga is a different situation.

Reading the transcripts it really sounds as if Horn wanted to do more than just protect his neighborhood.

I cannot talk about Texas law, but in most jurisdictions I know of, Mr. Horn would be guilty of a premeditated killing, even though he acted in defense of someone's property. There would be plenty of mitigating factors, though, so he would be getting off with a relatively light sentence.

I tend to agree with MadMax' assessment of the situation.

I really hate to name-call, but you are a complete, blithering, unreasonable mind-reading idiot. An amateur psychologist of the worst kind. Your judgmental and reactionary kind of thinking is why this country is in a lot of unnecessary trouble. Read below.

This story is night & day from Joe Horn. In this case, if every robber had been killed by the neighbor, even though they didn't have it in them to harm anyone, it would have been OK.

That is why I said, "The neighbor was never charged with any crime, but obviously the Horn saga is a different situation."

Does the KKK still have their bookstore and annual paramilitary training in Pasadena?

I grew up in and around Pasadena and wondered if things had changed much.

I understand that and was speaking to someone else. Thanks for the story.

Sorry -- I was just trying to add a personal bit to this -- it was terrifying for my grandparents seeing someone shot plus the all chaos. It was a huge stress for the neighbor because they knew where he lived -- that along with just wondering if he had killed someone. My grandparents fully supported what he did btw.

(I want to apologize in advance for bolding the entire post! ;) )

Did this guy really do this? And one of the thieves ended up shot in the back? And he told the 911 operator he was going to go out and kill them? And they were leaving his neighbor's house after robbing it?

Is this guy simply nuts? He could have easily shot a neighbor, or a neighbor's kid, while being a cowboy. I'm not against gun ownership at all or against someone protecting themselves or their family against an intruder, but it reads to me like a reckless, possibly insane person shot these guys needlessly. Ignored the 911 operator and just went out and blew them away. I damned glad I don't live anywhere near him, and hope I don't have any neighbors remotely like him.

I think he needs to be in an institution. Again, I can't emphasize enough how reckless it was to be shooting like this around his neighbors. Was a weapon pointed at him? That would be different. Were they breaking into his house? That would be different. Was anyone being assaulted? That would be different.

This dude is nuts. Jesus H. Christ, you don't play the cowboy in the middle of a neighborhood. There is a reason we have police and a system to get their attention. I made a post earlier, without reading the thread, regarding the loon encouraging people to mug folks in River Oaks. I didn't realize what the fuss was about. Good grief!

A quarter of me is happy that there are folks out there that would do anything to protect their neighbor's property. The other three fourth's of me goes  because there's some nut out there running around with a gun ready to shoot anybody he thinks may be doing something ilegal.

Sir Jackie Chiles - what you posted basically describes how the laws in Texas stand.

I don't know about Texas, but what I learned of New York Law in my Business Law class:

    Property owner duties (Premises Liability):

    to invitees - protect

    to licensees - warn

to trespassers - avoid intentional harm

You can't just SHOOT someone because they're standing in your lawn!

I understand if your life is in danger you will do what you have to do but you can't use trespassing as an excuse to blow someone's head off. It should be the last resort. Come on now, we're HUMAN, people! In any case, IMO I think less guns is better than more guns. Simple reason is that there's too many lunatics out there who shouldn't be running around with a gun.

They probably took a few hundred dollars worth of stuff?

In any case, nothing I own is worth killing over. Aside from the safety of my family, of course. Let me rephrase, nothing material I own is worth killing over. I'm not sure who I'd rather have as a neighbor, unarmed thieves breaking into my house or a crazy guy with a gun.

So people can't turn their lives around (i.e. Malcolm X)?

I hope this dude does some serious time. What kind of coward shoots someone in the back. I honestly don't see how a cop can get in trouble for shooting someone while fleeing but a citizen won't. He is going down.....

Edit: Well, I guess his guilt or innocence really depends on what matters most...the type of attorney he can afford. :(

After reading into the story and a few pages of this thread, I hope this guy spends the rest of his days in jail. What a f***ing COWARD!

He was on a mission to kill. This deaths could have been avoided many times. "Self Defense" is ridiculous because he put himself in that situation. He should have stayed his ass at home if he felt endangered. But he wanted to be play Cowboy for the day.

Robbing someone house can be akin to skydiving. Be careful or you might end up dead.
