    yeah that aspect doesnt look good for horn. but any half decent defense attorney would be able to cast enough doubt on premeditation. joe horn could even take the witness stand and say that he really didnt mean to kill them; it was a heat of the moment thing. so then what can the prosecutor say?

    i really think the prosecutor would be wasting his time on this case.

    Your logic here assumes because some home invaders killed Sean Taylor all home invaders would kill.

    It doesn't add up. You are assuming that breaking any law is worthy of the death penalty by vigilantes and we don't need the rule of law.

    You are also assuming that anyone who doesn't believe it is ok to kill burglars supports them rather than wish they would have been punished in a more suitable way.

    This is an aspect of Texas law that has intrigued me in recent years. Sometimes I think the legislature specializes in deliberately writing laws that can't convict people. I will bring this up again the next time we discuss a corporate criminal or politician who gets off with little or no punishment.

    I don't understand why and how you think an attorney would be able to cast doubt on premeditation in this instance. I'm not trying to be rude, but what do you think premeditation is?? How in the world can he argue heat of the moment when he watches this from afar...runs to get his gun...runs outside...and then shoots them?? Especially given the fact that there was a 911 dispatcher telling him not to along the way. How is that possibly heat of the moment???

    If the defense of property defense doesn't work, this guy has nothing. He absolutely thought this out...communicated what he was going to do...and then went and did it. How in the world is that not premeditated??

    The "heat of the moment" argument might lead to a reduced sentence instead of an acquittal. This case has plea-bargain written on it. I doubt it goes to trial.

    I have no doubt that any person who breaks into homes will also kill. It is the same mindset.

    I am not advocating the death penalty. I am advocating them being stopped by deadly force. They do not have to leave alive. They made the choice to risk their life. They can lose.

    As I understand it, this is the part of the law that pertains to this case. I guess you could attempt prove that the property could be recovered and Horn should reasonably believe that, but I wouldn't want to try to make that argument.

    It is a completely different mindset. I know people who have broken into homes, and killing is nowhere in their mindset. They are two very different things. A person who will break in to feed a family, or something may not kill.

    That is why there are different criminal penalties for breaking and entering, and murder.

    Your logic is flawed. Again they did make the choice and knew the risks. Because death is a possibility doesn't mean that is what should happen when it doesn't have to.

    If you actually believe the first sentence above, you need your head examined. I have no sympathy whatsoever for the victims in this case, but to say every thief has the mindset to kill is very unintelligent.

    They obviously have no respect for other people. They will kill. I'm not willing to take that chance. They don't deserve it.

    there is no heat of the moment argument. not with a conversation where someone in authority is talking him down. not where he has to go to get his gun...and has to walk outside to engage the situation...not where he's already communicated what he's planning on doing.

    heat of the moment is when the moment engages you...not when you engage the moment.

    A lack of respect does not mean someone is willing to murder.

    I can't beleive you don't see the flaw in your logic.

    Someone who runs a yellow light obviously has no respect. They will kill. they deserve to be shot and killed.

    I draw they line at breaking into people's home. Someone who is willing to do that is willing to do anything. They are an immediate danger to society and do not deserve any benefit of the doubt or trust. I have no problem with them being stopped with deadly force.

    mr horn knew that he was going to shoot them whether they were threateningh im or not. deadly force should be used as a last resort. mr horn took it as is fisrt, second, ignoreed 9/11 warnings and then took 2 lives.. if he wanted to wound them all he had to do was shoot at their legs. he commited a premeditated act by taking their lives.. he went out of his house looking for them..!
