    As long as the neighbors had the home owners permission I don't see an issue.

    I wonder what the home owner's insurance will say though...

    Legally I think they are fine but I can't help but feel like this couple was looking for an excuse to break out that new Smith and Wesson M&P they bought at the gun show last month.

    This was the second robbery in two days in houses across the street from each other.

    I wouldn't down play how violated these people may have felt with such a recent occurrence.

    I think it was drastic to go in looking for a potential confrontation but then again I'm not stupid enough to go 1) breaking and entering and 2) where I was just at two nights prior.

    If it wasn't the same guy, well, he picked the wrong house to be robbing at 2 AM.

    Their story sounds a lil off... They could have left the dude in the bathroom and waited for the police. But even if the neighbors were to be charged _ it probably wouldn't be with 1st or 2nd degree murder. There was already a home invasion in that neighborhood so the DA could probably try to argue "intent" but I seriously doubt a jury would convict them of a life or death sentence when they were reacting to the "fear" of having their homes invaded.

    Some type of manslaughter charge (5-10 years) may be the best the DA can do... And I seriously doubt a jury would convict of that either.

    Murder is the one act and or crime that one can commit and have a lot of wiggle room. You can kill someone and be out of jail faster than someone with a drug charge.




    Sometimes home invasions are violent crimes... And a person that will invade another person's home without fear of consequences is a criminal that is capable of doing anything. But rather violent are not home invaders do not only steal the victim's possessions but they violate and steal the victim's sense of safety and security in their own home (of everyone in the household). Some people even move after going through experiences like that.

    I'm not saying people deserve to die... But with what's been going on _ this case is probably the closest thing to a justifiable shooting of the bunch. And it was actually done by two civilians catching a home invader in the act who the police probably would have never caught. They're doing better than the cops.

    Things cannot always be replaced.

    It's not fair "value" to say you die if you rob someone, but it's not right to say that you should just let it happen while observing them to report to the police. Unless they steal a certain amount of property value, the police won't even make an effort to find them.

    You are supposed to watch baby pictures, family heirlooms, etc. get stolen or destroyed because it doesn't "require deadly force?" That's just nuts.

    Right. It was my understanding that a home invasion is different than a burglary. I may have misunderstand. And if the intruder is committing violence then I have an easier time justifying self defense unless the person killing the intruder put himself in the situation without necessity.

    The recidivism rate is out of control. TDC is merely a membership to a country club. In theory, prison sounds like a good idea, but it simply doesn't work for someone with a criminal mind. If you've been to TDC once, you'll probably wind up going back.

    The gov't didn't deny anyone due process. Pissed off citizens that are tired of the thieving took care of business. When you're committing a burglary, you need to realize that you may forfeit your right to due process. It's just an occupation hazard.

    I have no idea what restrictions guys on this BBS have on deadly force. Nothing surprises me. So you think I am being obtuse but I am just trained after so many years in D&D to take everything at face value.

    You said self defense, that means self defense. I guess you now realize there are more reasons. Good for you.

    You're stuck on rather the person is committing violence are not when that doesn't matter... The fact still remains they are intruders and they can get killed for that.

    It's rare to catch a home invader (and or burglar) in the act... And it's even harder to catch them after the fact. The only way people will stop doing that is with neighbors like that because those are the criminals the police can hardly ever get the cuffs on.

    This is not a kid getting gunned down for walking through a neighborhood by a over zealous citizen with a gun... This was an intruder in a house with the alarm going off at 2 in the morning two days after a break in within the same neighborhood.

    If everyone committing burglaries, robberies, (any crime where deadly force is justified) was killed by a pissed off citizen, the crime rate would decrease and we wouldn't have %50 of the working population being the only ones paying taxes. Win win.

    Call the cops, let them get away with whatever they steal and they keep coming back to rob more homes.

    If you are a robber and someone tells you they have a gun, get down, you absolutely have a reason to submit to the person's will; preservation of your own life.

    I don't rejoice in the death of anyone for robbing someone's home. That's a terrible trade off. However, you gave up your right to life when you decided to trample on the right to property of someone else.

    This is precisely the reason that countries whose legal system evolved from the Roman system don't use jury trials. The British/US system is a hybrid Germanic/Roman system. If the jury "likes" the crime, the jury nullifies the law. Scholars were raising the complaint 1000 years ago.

    The most egregious example of this is all the KKK type race crimes that people used to get away with in the South 50 years ago. If you want to see it, visit the Without Sanctuary webeite. Murder was so openly approved of that people made f'ing postcards, and nobody was at all scared of facing justice. LBJ had to institute a "fix" that strictly speaking circumvented the legal system.

    French/Italian legal systems have their own problems, but not this one. If the general population "approves" of your crime, you can get away with anything.

    I remember listening to a lawyer speaking of being accused of pedophillia talk about how, "Some crimes are so horrible that being innocent isn't sufficient defense." Along the same lines, "Some crimes are so offensive that no punishment is too much." I would bet that you could find a jury that would consider it just to torture home invaders to death by flaying them, if you looked a little bit.
