Top picks would ask the team (likely a crappy team with lots of cap room) to sign them to a big contract even more than the MLE. You don't think the league is that dumb, do you? You're talking about Randolph Morris. After his freshman year he declared for the 2005 NBA draft and went undrafted. He then took advantage of the NCAA rule that allows undrafted players who haven't signed with an agent to return to school. He played his sophmore and junior seasons at Kentucky. Once Kentucky was eliminated from the NCAA tournament in 2007, he signed with the Knicks within a week. That was legal because he had already been eligible for an NBA draft. The fact that nobody chose to draft him didn't matter. You only have to be eligible to be drafted.

The "big iranian dude" aka Hamed Haddadi is 25 years old. Any international player can be drafted once they reach 22 yrs of age (they must declare to be drafted earlier). So, Haddadi was eligible to be drafted in the 2007 draft. He didn't get drafted (since nobody knew who he was) and therefore became a free agent.
