So Flynn basically got Caponed. Law enforcement knew with 98% certainty that he was doing mob like activities that murdered people, but the only way to achieve the threshold of evidence for a conviction, they needed a direct admission so they just went with lesser tax evasion charges because that can be "proven beyond a reasonable doubt" which is the threshold for conviction.
