Obama administration will not defend gay marraige law

    This isn't repeal, which can be only done by Congress, but is a finding whether the law is Constitutional or not. You seem to be confusing the nature of actions done by different branches of government.

    As far as enforcement the Executive branch is still enforcing the law. It just isn't defending it in court. That is a fine but very important distinction.

    I don't think this is a finding of whether the law is constitutional or not. By refusing to defend the law, it is likely the law will be found unconstitutional. I would like to see the law properly repealed. It is not good to have it found unconstitutional in a questionable manner.

    Obama is a complete amateur. The more and more I get to know about him, the less impressed I am with him. AND, the more and more I believe he was elected due to bs marketing hopey hopey change garbage and the fact that he's only half white. Barf.

    No, this has happened plenty of times throughout history in numerous administrations. People may legitimately agree or disagree with the decision, but people attacking him for doing something unacceptable are just looking for reasons to make political attacks.

    Sure -- folks like Batman Jones even admitted to that being part of their decision making process. It's not like it's some secret. Not sure how that could be interpreted as racist? Wouldn't racists NOT vote for the half-white guy?

    President Bush has once again decreed that his personal pen is the highest law of the land. In a statement issued on October 4, 2006, he announced that he would ignore many provisions of the Homeland Security appropriations act he signed earlier in the day. His action vivifies that the rule of law now means little more than the enforcement of the secret thoughts of the commander in chief.

    Bush’s postsigning statement declared that he would interpret many sections of the new law “in a manner consistent with the president’s constitutional authority to supervise the unitary executive branch.” In plain English, this means that many of the limits that Congress imposed on Bush’s power — and that he accepted when he took the money Congress appropriated — are null and void. Why? Because the president says so.

    You are right and wasn't precise enough in my statement. The Executive branch can't find the law unconstitutional but by not defending it that is more likely the result.

    That said I don't think this is necessarily that questionable as I don't think the court will just render a default judgment in these cases and I believe many other groups are filling friend of the court briefs in support of DOMA so there is some defense to it.
