Who cares? If they have Kaepernick, they are automatically a good team. He's elite. No doubt about it. They will extend Aldon Smith, and still have Navarro Bowman, Patrick Willis, among others. Throw in one of the best coaches in football, and the 49ers are going to be absolute money for a long time.
Texans couldn't re-sign him if they traded for him. Texans are capped out. Will be for the next 2 years.
They had the cap space to take his contract this year. Maybe no other team in the NFL would have done that.

People don't even say Flacco is "Elite" despite what he did last year and the last 5 years in the playoffs. Look at the team assembled for Kap. Heck Smith was 6-2 with 49ers last year and yet he got replaced for injuries. Year before that Smith took his team to NFC championship game. Even Smith was supposed to be able to take them to Super Bowl last year...
Living in the bay area I do watch all their games, and they have a line that's so far and above anyone else, and so much more talent on defense then anyone else (brilliant management. Coaching is horrid so you have a 15-16 win level team win 11 but the talent on that team is unreal.
