New Mexico Goveror assumes emergency powers, suspends 2nd Amendment

    This is a true test of law enforcement's oath to uphold and defend the Constitution. Her order is a cut and dry violation (not to mention her overriding New Mexico law)

    I dont anticipate she will make any attempt to enforce her order.

    How exactly is temporarily suspending open carry “suspending the 2nd Amendment”?

    Is everyone in Albuquerque required to turn in their guns?

    Can't defend the governor on this one. There are other things in the order that seem fine -- inspections of gun dealers, reporting on gunshot victims, etc -- but suspending carry seems designed purely for picking a fight that she will lose. I hate and want to abolish the second amendment, but you can't just administratively impose a cooling down period on people's enumerated rights. That's ridiculous.

    Again, I'm asking...does the 2nd Amendment specifically say that open carry is allowed nationally? It's a state law...correct? Not all states allow this. So is it an enumerated right that's been taken away or is this a temporary measure to try and calm things (which isn't likely to work)?

    It specifically says your right to bear arms shall not be abridged. We have a legal framework for gun ownership which in New Mexico includes the right to carry your guns around. I don't like it, but it is what it is. So for a governor just declaring one day you can't do it is changing by fiat the terms on which we employ our second amendment right. Seems pretty clear to me this is not simply a suspension of state law (which is problematic enough) but a violation of civil rights.

    Try a hypothetical with me that may or may not apply. Before Dobbs, the right to an abortion derived from an interpretation of our enumerated right to privacy. What if Abbott pre-Dobbs declared a one-month moratorium on abortions in Harris County after a few unfortunate abortion-related deaths. He rationalizes that abortion practices in Harris County must have somehow gone off the rails because the deaths are much higher than statistically expected, and we obviously need some time to review and reform our practices. Further, he says it's just one month, and Harris County women can go to another county for an abortion, and anyway a right to an abortion isn't explicitly endorsed in the Constitution. Acceptable?

    Look...I'm not saying this is the right move at all. It's clearly going to backfire (no pun intended). My only point is that no one has to turn in their gun. No one is coming to take their guns. They just can't walk around with them on their hips for a a few weeks.

    Man, even David Hogg is against it.

    The SC pretty much said you can walk around (with reasonable restrictions, which likely doesn't include a blanket ban on conceal or open carry) with them on your hips. The Court's reasoning is that the 2A gives people the right to defend themselves outside of their homes. Of course, ever since that reasoning and the State opening up carry with extreme carelessness, crimes with guns have gone up, not down.
