Need some quick advice on illegal towing...

    I'm sorry but I don't know the name of the lot, however, my wife might remember (this was about 5 years ago). If she does, I'll post it. Obviously I can't ask my f-i-l.

    I had heard that the maximum fee was around $15 or $20 per day but at the time the other wrecker (from the dealership) just paid the fee as it was going to be charged back to the insurance co. anyway. As it turned out, the POW wasn't what got the car released, it was the fact that my F-I-L was such a large man.

    In this kind of a situation, everyone is going to blame everyone else. Their strategy is to push the problem to someone else hoping they will take care of it or you will get sick of dealing with it.

    ALL parties involved are responsible for your trouble. The towing company towed the car without reason, the holding lot collected money for the crappy towing company, and the apartment complex hired the towing company to patrol their complex. They ALL have the power to resolve the situation.

    Call the towing company and tell them that you have photographic proof that you towed without reason. If they try to pass the buck, tell them that you still believe they are responsible and should work out the reimbursement for you even if they aren't the ones who will pay it. Give them the name and phone number of your complex manager and the holding lot.

    Call the holding lot and tell them that they are working with careless people, and that you see them as at least partially responsible. Give them the same phone numbers and ask them to work out the reimbursement.

    The apartment complex is really the party that has the leverage in this situation. They hired the towing company and have the power to fire them. They should also be on your side because YOU PAY THEM RENT, and can leave.

    There is no benefit to taking any legal action and the threat is rather meaningless when you are talking about $110, but you can piss them off by calling them every single day asking them if they have worked the reimbursement out. Just keep telling them that they made a mistake and need to sort it out with each other.

    Don't lie about the picture. Tell them where you got it if they ask. Who cares. You did nothing wrong obtaining it. That will also give everyone a bigger headache, which will help you get your money.

    Good luck, and don't ever yell at anyone on the phone. That will only turn them against you. Just be persistant and honest. Tell them what you want.

    I also have a tow story. Went to Edwards Cinema on weslayan, didn't feel like paying the garage fee, so parked at a little coffee shop lot across the street....right infront of the tow sign. Needless to say, I way towed.

    ..... I was wrong and all, but I still hate them. :mad:

    Take the 110.00 out of your next rent check and put the ball in their court. That should get their attention.;)

    It'll get their attention but it might not do you any favors. Texas is a management-friendly state. They can evict you pretty easily for nonpayment. And, management doesn't usually feel cooperative when you don't pay your rent.

    I'd suggest that once he figures out which party (if not both) is responsible, send them a formal letter by certified mail requesting a refund and threatening legal action (for the apartments) or reporting to the State (for the tow lot). Give them a defined window to comply and, if they don't, carry out your threat.
