I think this scenario was partially why Roberts ruled the way he did in Trump v US. It was more of a consequentialist decision than an originalist one, but significant in the sense that it'll be near impossible for Trump to go after Biden legally.

Robert’s and co. ruled the way they did because like most of their recent decisions they gave themselves more and more power. All Trump has to do is call up his pal Alito and convince him to get a majority to agree that a “crime” or allegation of a crime isn’t an “official act.” They get to hold the cards and get a quid pro quo if they want in return to make the judgement based on whatever rationale they want. If Trump knows in advance from his buddies how they’ll rule on the allegation being “official” or not he’s got everything he needs to send the dogs after Biden.
