[Music Sampling] Who owns the rights to NBA audio broadcasts?

    I'm trying to make a song for release on iTunes and I would like to take a few 5 second in-game audio broadcasts and incorporate it into the song. Am I able to use these without obtaining any legal documents? I plan to release my song on iTunes next week for $0.99 [all profits going to charity btw], but I'm just afraid that I'll get sued if this song get's more than 10,000 downloads.

    Pretty sure that you will need permission to use anything from the NBA whether it be audio or video. Unless it is a famous broadcast moment that everyone will recognize, you should be able to recreate it with some fx and voice over work. I wouldn't risk publishing anything with samples without clearing it first.

    you need a copyright lawyer to listen to your stuff. It all depends.

    good idea. court has ruled that even 1 Sec sampling, repeated throughout a song is copyright violation. on the other hand, sampling might be ok, if it is transformative enough. this is case by case judgement. no one can tell you over this board. you need a lawyer if you want it, but thats probably not cost effective considering you are doing it for free. or you can just pay for the license, it shouldnt cost too much. you can always add that cost to the song.
