That our rights exist naturally is a theological or at least a philosophical position and not something that can readily be accepted as universal fact. In my own philosophical framework, I don't think such rights come from God or nature; that they come from the Constitution and the US Government only. It is my historical opinion that the authors of the Constitution felt the same way (despite some lip-service to the contrary). I think the Constitution is a practical application of the Contract theory floating about at the time: that government is the embodiment of a contract between people that provides for their mutual and corporate governance. In such a system, they could as easily have included the right to not wear pants if they wanted. I think it is a bit dangerous to ascribe our rights to God or nature. Would that mean that the Constition is Revelation in some sense? This approach elevates the document from a good tool to something like Scripture. Or, if it only reflects the dictates of nature (not sure how that one works), did our forefathers engage in some sort of study to devine these rights? Are we sure they didn't accidentally give us extra or miss a few? Can we review their data? With the above caveat, I'll say protection from search and seizure.

I've been thinking a lot about this recently...it's a really good question. I don't think I'd say freedom of religion..mostly because they can't stop me from worshipping God unless they just flat out kill me. Then I'm a martyr. I think I'm leaning towards search and seizure laws...these are extremely practical and keep away the police state mentality we see in other countries, where a man has no refuge even in his own home from the government. But the protection of private property rights have been all the difference in this country, in my opinion. They really set up a different society and culture.... And due process!! How could a lawyer leave out due process??!! Man...the Constitution is so freaking cool.
