In which case, Judge Sullivan’s job is very much not over, and the DC Circuit’s order that he proceed with dispatch about the existing charges presumably no longer applies.

Flynn was questioned under a law that says unauthorized citizens cant negotiate with countries we are in dispute with. So at this point Obama has sanctioned Russia for interference and Trump is now in office. On tape Flynn is asking Russia not to escalate. Is that a treasonous act? Not to mention why isnt he authorized?
Well, I happen to think lying to the FBI about international connections when you are going to be part of the governing administration is serious. He failed to disclose that he was working as a foreign agent and had to retroactively acknowledge that. You may not care, but many people who from the United States do care. It's a matter of national security.
