    Difference, of course, being that two adult women can give legal consent to marrying the same man, if that was an option. Your donkey friend really couldn't do that.

    Exactly. This also eliminates anyone who thinks this would somehow lead to adults inanimate objects. Legally, the donkey cannot enter into a contract.

    Than can r****ded people, or crazy people, not get married, I.E. someone who gives consent but is not judged of right mind to do so by legal standards?

    I dumped the donkey for an elephant. The donkey whined too much didn't want to do any work.

    To be honest, I don't know. But I don't think this legal question should be a basis for not allowing homosexuals to marry.

    Not to mention all the babies the donkey was murdering. Of course, you do need to watch out for your new love's penchant for stepping on the poor, minorities, homosexuals, and anyone who dares disagree with him.

    If someone is judged as not of sound mind by the state, incapable of understanding what marriage is, I don't think it is legally binding. Similar to anyone who marries/enters into a contract under duress (i.e., shotgun wedding). All concerned parties have to understand what they're doing, isn't that logical?

    Forgot the-- This is what conservatives who don't like gay marriage are told.

    RM95- My Elephant and I are doing great. We've settled down in a quiet little town in Montana where we meditate on the four loves every night before getting out our shot guns and shooting random pigeons that fly by.

    I have no idea what that had to do with the preceding donkey/elephant discussion.

    Republicans don't hate poor people. I think thats what I meant. ;)

    To respond to TJ and basso- I'm a supporter of gay marriage and it is an important issue to me, and it's important to me that Kerry doesn't support it. It will be an issue when I decide between him and other dem candidates. But it's only one issue, and it's probably lower on my list right now than foreign policy and the economy. If Kerry's the dem nominee, I'm still voting for him over a man who's spearheading a constitutional amendment to ban gay marriage nationwide.

    MadMax- excellent post, really.

    I have plenty of friends who are married but are not religious. I think there are plenty of secular americans who see marriage as an important institution and a sacred one, but not a religious one. It could be said that in america and much of western europe marriage is as a much a social/cultural construct as religious, probably more so.

    I am baffled by people who see the need to 'defend' the institution of marriage. What does the action of any consenting loving adults who want to dedicate their lives to each other have to do with you? This includes polygamy. If people are adults of sound mind consenting to spend the rest of their lives together we have no place to exclude them from the benefits of marriage under law. This whole idea of defending the sanctity of marriage by excluding same-sex couples is silly. You want to defend the sanctity of marriage? Get to work on the horrible examples made by heterosexual marriages in this country. Outlaw adultery and divorce, set up punishments for coveting thy neighbor's wife.

    I don't hate them. I never said anything about you being homophobic/hating anyone - I'm just trying to get you to look at your beliefs. I actually shared your concerns at one time but then argued with someone and I ended up where I am now.

    If someone is r****ded/crazy enough to be legally declared that way, if they cannot understand the contract, then it cannot be entered into. Otherwise I could get Bill Gates really drunk and have him sign away his fortune to me in exchange for a nickel. The way I understand the law that wouldn't be legally binding because he was intoxicated.

    Nolen answered better than I many of the same feelings I have. Kerry is wrong in not supporting Gay Marriages. Personally I believe he's afraid to take an unpopular stand. Anyway the reason it's important is because it's an issue where Americans look at other Americans and try to deny them something. I think that's wrong. I don't think it's true to the principles that this country was founded on.

    Why is it called defense of marriage? Homosexuals aren't trying to attack the idea of marriage, rather they want to take part in it, and for those that would get married would probably want to strengthen the institution rather than weaken it. People generally don't want to weaken something they are a part of.

    TJ is right gay marriage is an important issue to liberals because it's a matter of trying to stop discrimination which should always be important. But as others have pointed out, if our choice is between Kerry who doesn't support same sex marriages but wants to protect homosexuals from being legislated against and a man who wants to pass a constitutional amendment that would allow discrimination against the group, I think the choice is clear.

    i think you missed the point. The point was, I knew you didn't hate r****ded people. I don't hate gay people, by advocating they can't get married (much as you did with r****ded people) doesn't mean you hate them.

    Max has a point that we should make better the marriages that are already here, I'm definitely down for that.

    Are churches going to be forced to marry gay couples, like will the Catholic church be able to deny them marriage?

    This is all very crazy. It's important we do the right thing.

    Of course not. There are plenty of churches, priests, ministers and reverends in every state that would be happy to marry gay couples.

    Thats not what I'm saying, I'm saying, if two guys want to go down to St. Mary's Catholic Church and get married, and St. Mary's says no, we don't do that in the Catholic Church, is the government going to come in and be like, come on now St. Mary's you can't discriminate, nudge nudge...?

    No. The Church can allow whoever they want to get married. Currently, it is legal for divorcees to get remarried but it is not allowed in the Church (have to get annulled first). The gay marriage arguments are now in the legal realm, not the religious. In this case, they are exclusive of each other.
