    I have seen enough to know that he hates white people. I don’t really care what his stupid reasons are. He point blank said he hates white people. A racist is a racist. Had he said the same thing about any other race, he would’ve been banned from here and he would have zero defenders trying to explain him.

    but.....I am just gonna ask the family and all the folks that are "OMG MENTAL HEALTH HOMELESS".........what have you done for this man prior to his death?

    tell me one thing you have done for mental health patients or to combat homelessness..

    well see now, if those folks (a) have not yet been charged, and therefore (b) have not yet been convicted, it is (c) premature to ask about punishment--indicating (d) that your question is a non sequitur

    I don’t live in NYC so wouldn’t have done anything to help Jordan Neely personally but I’ve worked on affordable housing projects and shelters. I have a couple of friends who are homeless activists and have helped them and donated to their causes.

    As I said earlier in the thread homelessness isn’t a simple problem and no single individual or government policy will solve it. In this particular case Jordan Neely is representative of a larger problem but guilt or innocence shouldn’t be determined because homelessness is a problem.

    I’ve been listening to some legal and use of force experts in this case and it sounds like this isn’t a very clear cut case and conviction of will be difficult.

    In NY self-defense legal defense has to be disproven by the prosecution and the starting point is that the defendant did act in self defense. so rather than this being so much a trial about whether Daniel Penny committed manslaughter it’s a trial about whether self defense wasn’t justified beyond a reasonable doubt.

    A big factor in that will be that others helped Penny restrain Neely and that only one bystander appeared to warn Penny to release the hold. That would be a sign that most people on the scene also felt that Neely was a threat and Penny was justified.

    From the use of force standpoint there is uncertainty about how long the choke was actually on and also whether Penny knew that he was killing Neely. The encounter between them is 15 minutes but that may not mean Neely was being choked the whole time. Also Penny’s training comes into question about how he was trained to use this technique. Again a marine is not trained the same way a competitive martial artists is or an LEO.

    How the judge conducts the case particularly jury instructions could make a big difference. The defense is likely to bring up the issue of homelessness and that many subway riders are frequently harassed by homeless mentally ill people, also will bring up issues of why NYPD didn’t respond fast enough or keep Neely in custody before. The judge thought May narrow the argument to just the facts of this particular incident in which case the defense either won’t be able to bring those up or the jury will have to set those aside. My guess is that the judge will do so and while this is a different jurisdiction we’ve seen judges in similar cases do this, such as in the Derek Chauvin case evidence of George Floyd’s history wasn’t allowed.

    Does that mean there isn't even a question on if he used excessive force that ended up killing? I would think the defense would also try to say not only did Penny didn't intended to harm, but he didn't think his method would do harm.

    Self defense seems pretty weak here. I didn't see any evidence that he actually physically did something to anyone. He didn't seem to be resisting when restrained either. A passenger also warned Penny that Nelly might be dying.
